For any violation of any provision of this article, all persons violating the same shall be punished by fine in accordance with the general penalty provision found in section 1.01.009 of this code, by proceedings before the municipal court of the city. Each provision hereof which may be violated and each occasion upon which such violation may occur shall be considered separate offenses.

It shall be unlawful for any person, firm or corporation to sell, offer for sale or display, or cause or attempt to sell, offer for sale or display any goods, wares or merchandise from any vehicle occupying any public street, alleyway or other public property within the city, whether such vehicle is moving, stopped, parked or standing.

It shall be unlawful for any person, firm or corporation to use, to cause to be used, or to attempt to use any chimes, bells, whistles, music or other sound which may be heard at a distance of greater than fifty (50) feet on any vehicle from which goods, wares or merchandise are sold, displayed or offered for sale in the city while the vehicle is occupying any public street, alleyway or other public property within the city.

The provisions of section 8.09.002 hereof shall not be applicable when the vehicle from which any person, firm or corporation sells, displays or offers to sell any goods, wares or merchandise is lawfully parked or standing on private property or where the person or persons operating such vehicle or selling, displaying or offering for sale, goods, wares and merchandise contained within such vehicle leave such vehicle and sell, display or offer for sale such goods, wares and merchandise upon private property, provided all other applicable ordinances have been complied with.
