Except as otherwise provided in this article, it shall hereafter be unlawful for any person to carry on a temporary use or construct a temporary building for the use of an asphalt or concrete batch plant, carnival, circus, real estate sales office, construction office, portable church or school building and other temporary use as determined by the city manager or his designated representative, within the city, without having first obtained a permit therefor from the city.

All temporary uses will be required to apply for a temporary use permit. These shall include but not be limited to:
(1) 
Asphalt batching plant.
(2) 
Cement batching plant.
(3) 
Construction office.
(4) 
Real estate office.
(5) 
Portable church building.
(6) 
Portable school building.
(7) 
Mobile or modular home.

Asphalt batching, temporary.
A designated area, allowable after application, for the temporary manufacturing of asphalt for installation within subdivisions in the city as approved by the city manager or his designated representative.
Cement batching, temporary.
A designated area, allowable after application, for the temporary manufacturing of cement for installation within subdivisions in the city as approved by the city manager or his designated representative.
Construction office.
The use of a portable trailer for supervision of a construction site allowable for a specific period of time in a designated area upon issuance of a temporary use permit as approved by the city manager or his designated representative.
Mobile home or modular home.
A home certified to meet the building code of the state department of housing and community affairs which is occupied by an elderly or disabled person and which is located on or is contiguous to property developed in accordance with the Uniform Building Code with a home occupied by a relative within the first degree of consanguinity or affinity, and which shall be allowed in cases of extreme hardship as determined by the city council. The status of a temporary permit for a mobile or modular home shall be reviewed on an annual basis by the city council.
Portable church building.
The use of a portable building or structure as an accessory building or structure in conjunction with the primary use of real property by a congregation, classes or assembly of people for a church or church-related activities, allowable for a specific period of time in a designated area upon issuance of a temporary use permit as approved by the city manager or his designated representative.
Portable school building.
The use of a portable building or structure as an accessory building or structure in conjunction with or for the primary use of real property by a class or assembly of people for a school or school-related activities, allowable for a specific time period in a designated area upon issuance of a temporary use permit as approved by the city manager or his designated representative.
Real estate sales office.
The use of a portable or permanent building or structure for the sale of real estate within a new subdivision allowable for a specific time upon the issuance of a temporary use permit as approved by the city manager or his designated representative.

Each application for a temporary use permit shall be in writing to the city building official on forms furnished by the building official, and shall set out the following:
(1) 
Name of the applicant;
(2) 
Applicant’s permanent address;
(3) 
Name and address of the firm the applicant represents;
(4) 
Narrative statement of the specific temporary use applied for;
(5) 
Specific site plan drawn to scale showing the specific dimensions and arrangement of the proposed temporary use; and
(6) 
Specific time period for which the applicant is requesting the temporary use.

The permit fees for administering temporary uses within the city shall be as established by the city council.

Where work for which a permit is required by this article is started or proceeded with prior to obtaining said permit, the fees shall be doubled. The payment of such fee shall not relieve any person from fully complying with the regulations prescribed in this article.

Fees for approved uses may be exempted for nonprofit charitable organizations when the applicant files with the required application supporting documentation. For the purpose of this section, proof of 501(c)(3) Internal Revenue tax exemption will suffice as supporting documentation.

All temporary uses shall conform to the following requirements:
(1) 
If temporary power is required, it must be supplied overhead or underground directly to the specific use. No open wiring lying directly on the ground will be allowed.
(2) 
All building or structure setbacks shall conform to the current zoning district for principal uses on the land in which the temporary use is occurring.
(3) 
The maximum time period for a temporary use permit for real estate sales offices and construction offices is twelve (12) months. The time period for all other temporary use requests will be determined by the city manager.
(4) 
A new permit is required for each new location, whether or not the temporary use is located on the same property or on a new site.
(5) 
A minimum of four (4) parking spaces shall be designated on the general site plan for construction offices and real estate sales offices.
(6) 
The building official may revoke a temporary use permit for noncompliance with the above requirements.

(a) 
The city manager or his designated representative shall approve, conditionally approve or disapprove all temporary use requests presented, except as approved by the building official under section 8.10.008(5) and (6) [sic].
(b) 
The city manager shall designate a specific time limit on all temporary uses approved.
(c) 
No appeal on the same request shall be filed within a period of one year from the date of denial.
