The purpose of this article is to establish guidelines for the use of the Village's community "burn pile" and residential and commercial garbage pickup.

The area hitherto established as a Village burn pile, or any other area hereafter so established, shall be considered as the Village burn pile as the phrase is used in this chapter.
A.
All persons or their agents, having the right to use the facilities of the Village burn pile as in this chapter provided, shall abide by and conform with all the regulations herein provided, and/or with all instructions or orders of the person authorized by the Board of Trustees to supervise dumping operations within said Village burn pile, and with all signs and notices posted at the Village burn pile by order of the Board of Trustees, or the Superintendent of Public Works on direction of the Board of Trustees, particularly with the signs which designate where dumping operations are permitted, or prohibited in any particular area, or site within the Village burn pile, when such signs are posted by order of the Board of Trustees, or the Superintendent of Public Works on direction of the Board of Trustees.
B.
No person having the right to use the Village burn pile in this chapter shall be permitted to enter upon or use the Village burn pile for burning operations except during the hours specified by notice posted in a public place (post office, Village Office, or similar) or by appointment or by special permission and supervision of the Superintendent of Public Works or the Village President.
No person shall, except by permission of the Board of Trustees, remove any article or object, which has been deposited or dumped and left at the Village burn pile.

It shall be the duty of every owner or his or her agent, or occupant of any house, building, flat or apartment, or tenement in the Village where people reside, board or lodge at all times to maintain in good order and repair a metal or plastic receptacle with a tight-fitting lid to collect and contain solid waste between regularly scheduled pickups. The receptacle shall not exceed 40 gallons' capacity or have a gross weight of more than 50 pounds.
No garbage or refuse of any kind shall be deposited in any street, alley or public way, except as is provided in this chapter; and no such refuse shall be so placed that it can be blown about or scattered by the wind.
A.
Definition. A "household," as referred to in this section of this chapter, shall be deemed to mean each separate family, apartment unit, or condominium unit. A "commercial customer" shall be deemed to mean each separate business entity, whether same may utilize a building entirely or whether several of same may exist within a building.
B.
Household customers. The Village shall charge and collect a fee for the collection of garbage and refuse for household customers, from each household.
C.
Commercial customers. The Village shall charge and collect a fee per pickup; provided, that if any pickup includes more than one dumpster, the fee shall be per dumpster per pickup.
D.
Collection. The Waterworks and Sewerage Department personnel of the Village of Forrest are authorized to collect the said regular water and sewer bill of the Village of Forrest, specifically itemizing the said garbage fee separately thereon.
E.
Enforcement. The personnel of the Waterworks and Sewerage Department are authorized to discontinue water service to any household which has water service and which does not pay the garbage pickup fee on a current basis or abuse or is in violation of Village Services Ordinance.[1]
F.
Use of funds collected. Funds so collected shall be utilized for Garbage Department expenses and purposes.
G.
It is found that the fee established hereby is reasonably related to and based upon, the cost of providing garbage and refuse pickup service.
