Whenever it shall appear to the Mayor or member of the Village Board, or to any employee of the Village, appropriately authorized by the Mayor, that damage is being done or may be done or is threatened to Village streets and alleys by otherwise lawful use of any vehicle or equipment, because of the weight thereof, the nature of the tire or tread or track thereof, or for any other reason, then in such event the operator or owner of said vehicle shall be notified to immediately cease using the vehicle or equipment on such street or alley or in such manner as causes or threatens damage or harm to the street or alley. Notification may be made by the Mayor, any appropriately authorized Village Board member, or any Village employee or any law officer. Notification may be made directly to the person operating the vehicle or equipment, or directly to the owner of said vehicle or equipment, or by posting a notice on the said vehicle or equipment, or by posting the street or streets and alley or alleys.

Any person violating any provision of this chapter shall be penalized an amount of $750 per occurrence. Each day the violation exists shall constitute a separate occurrence.
