The purpose of this article is to protect the safety and health of the Village's children and adult residences; and to control nuisance caused by animals.

A.
All dogs will be licensed and vaccinated in accordance with county and state regulations. Dogs will not be allowed to run free on Village property. Dogs shall be leashed when not confined to the owner's property or to the property of a friend, relative or neighbor that has given permission for the dog to run freely.
B.
Enforcement.

Dogs allowed to run free and where a formal complaint has been filed, may be restrained and impounded in a place designated and set apart for that purpose, in the manner provided in the Animal Control Act (510 ILCS 5/1 et seq.) and the Rules and Regulations of the State Department of Public Health.

Whether or not the dog is claimed, the owner or caretaker of the dog will be fined $100 (per dog), payable to the Village Clerk, in addition a $50 (per dog) transportation fee, also payable to the Village Clerk, to be used to reimburse to the transporter for expenses. In addition, the owner will be responsible for all charges imposed by the impound entity. Each day a violation occurs shall constitute a separate offense.
A.
Dogs will inherently bark or howl from time to time and for various reasons; however, when a formal complaint is received by the Village of barking or howling dogs that unduly disturb the peace, tranquility, and serenity of the neighborhood, the owner or caretaker will be notified and the owner or caretaker must take immediate action to abate the disturbance.
B.
Enforcement. Once a formal complaint is received by the Village, the Village will inform the owner by written notice of the complaint/violation. The owner or caretaker of the dog is then expected, without penalty, to take appropriate action to permanently abate the problem within seven days of the date of the notification. In the event there are any subsequent formal written complaints, the resident of the property where the offending dogs are housed will be fined $25, payable to the Village of Forrest, for each formal complaint thereafter.
A.
Cats are not required to be licensed and vaccinated; however, they are required to be collared with the owner's name and or contact number. Cats will not be allowed to run free.
B.
Enforcement. Cats, with proper identification, allowed to run free and where a formal complaint has been filed, shall be restrained and impounded in a place designated and set apart for that purpose, in the manner provided in the Animal Control Act (510 ILCS 5/1 et seq.) and the Rules and Regulations of the State Department of Public Health. Whether or not the cat is claimed, the owner will be fined $100 (per cat), payable to the Village of Forrest, plus a $50 (per cat) transportation fee, also payable to the Village of Forrest, to be used to reimburse to the transporter for expenses. In addition, the owner, must neuter or spade the cat, furnish the Village with documentation to that effect, and will be responsible for all charges imposed by the impound entity.

C.
Enforcement. Cats, without proper identification, may be captured, terminated and disposed of in a manner acceptable to and by a Village official, full-time Village employee or authorized agent of the Village.
Equine, common or uncommon livestock, and/or poultry including ducks, geese, or similar fowl:
A.
Equine, livestock and/or poultry are not allowed to be kept within in the corporate limits of the Village of Forrest.
B.
Enforcement. The property owner will be notified by mail (return receipt requested) and the notice will be considered delivered within five days whether ignored or refused. The owner will have 10 days from the mailing date of the notice to remove the animals from the Village corporate limits. Noncompliance will result in a $100 per day, or partial thereof, fine payable to the Village of Forrest.
All persons who capture, detain, transport, or terminated in animals in violation and in accordance with the Animal Control Ordinance, will not and cannot be held responsible for damages to property or animals while capturing, detaining, transporting or terminating the offending animal.

As used in this article, the following terms shall have the meanings indicated:
Includes all animals, male and female, of the family Felidae.
Any animal with a known propensity, tendency or disposition to attack without provocation, to cause injury or otherwise to endanger the safety of human beings or domestic animals;
Any animal that attacks a human being or domestic animal without provocation; or
Any animal owned, harbored, trained or used for fighting against another animal.
Includes all animals, male and female, of the family Canidae.
Includes any person who shall harbor, suffer or permit any dog or cat to remain on any premises within said Village under his or her control or charge.

It shall be unlawful for any vicious, ferocious or dangerous dog or cat, or dog or cat sick with or liable to communicate hydrophobia or any contagious or infectious disease, or any dog or cat which may in any manner unduly disturb the quiet of any person or neighborhood within said Village, or which shall bite, intimidate or injure any person or domesticated animal or to run at large in the street, alleys or public places in the Village of Forrest, or upon the private premises of any person other than the owner or keeper thereof, or any other place in said Village, or to unduly disturb the quiet of any person or neighborhood in the Village. The violation of this section is hereby declared to be a nuisance. The Village President or any Trustee of said Village, or any person designated by the Village President, is hereby authorized, and it shall be the duty of such person, from time to time, to abate said nuisance by restraining and impounding such dog or cat in the manner herein provided in § 505-11 and by disposing of the dog or cat in accordance with the Animal Control Act (510 ILCS 5/1 et seq.).
A.
It shall be unlawful for any person (owner or keeper) to suffer or permit any vicious, ferocious or dangerous dog or cat, or dog or cat sick with or liable to communicate hydrophobia or any contagious or infections disease, or any dog or cat which may in any manner unduly disturb the quiet of any person or neighborhood within said Village, or which shall bite any person or injure any person, to run at large in the streets, alleys or public places in the Village of Forrest, or upon the private premises of any person other than the owner or keeper thereof, or any other place in said Village, or to unduly disturb the quiet of any person or neighborhood in the Village.
B.
Penalty. Any person violating this section shall be fined $750 per animal in violation. For purposes of this section, each day of violation shall be considered to be a separate offense.

All dogs or cats in violation of this article, which are not killed or destroyed under the provisions thereof, shall be restrained and impounded in a place designated and set apart for that purpose, in the manner provided in the Animal Control Act (510 ILCS 5/1 et seq.) and the Rules and Regulations of the State Department of Public Health.
B.
Penalty. At any time within seven days after notice to said owner or keeper has been given, said owner or keeper may have the right to recover the possession of such dog or cat, if it will not jeopardize the public health or safety, by the payment of the assessed fine and a per-animal impoundment fee plus a per-animal transportation fee, in amounts as set forth in the Fee Schedule on file in the Village Offices, to the Village Clerk. In addition, no animal shall be released to the owner or keeper until all licenses and vaccinations have been verified for said animal(s) and the animal has been microchipped in accordance with 510 ILCS 5/10.
