Unless exempt pursuant to §
130-6 of this chapter, all satellite antennas shall comply with the specifications and standards set forth herein. Satellite antennas are permitted uses within all districts upon receiving site plan approval from the Planning Board pursuant to the procedures of Chapter
269 of the Code of the Town of Webster. If the specifications and standards are not met, site plan approval shall not be granted. In granting site plan approval, the Planning Board may impose other conditions and restrictions on the physical layout, use, installation and location of the satellite antenna if such restrictions are deemed necessary by the Planning Board to provide satisfaction of any of the conditions below:
A. The specifications
and standards to be used by the Planning Board in considering an application
for a satellite antenna include the following:
(1) The specifications and standards set forth in §
130-12A of this chapter.
(2) The satellite
antenna must be designed for the particular site and neighborhood
location to be unobtrusive with respect to material, color, scale
and positioning.
(3) The satellite
antenna shall be determined not to be detrimental to or injurious
to property values of the surrounding neighborhood.
B. Satellite antenna which receives final site plan approval by the Planning Board after public hearing based on compliance with the specifications and standards in Subsection
A above shall be constructed only in according with the following location parameters, bulk standard and other limitations:
(1) Any conditions
and restrictions made a part of the Planning Board's approval of the
antenna as a special use/conditional accessory use shall be complied
with.
(2) An antenna
shall not be installed as a sole structure on a lot and shall not
be a permitted principal use or structure in any district in the Town
of Webster.
(3) Antennas,
when located on a lot and not attached to any building, shall be so
installed that the portion of the antenna's dish closest to the ground
may not exceed two feet from the ground upon which the antenna sits.
The highest portion of such ground-mounded antennas or related functional
or structural elements or their components and appurtenances thereto
shall not be more than ten 10 feet above the grade immediately surrounding
the construction.

(4) The dish
portion of an antenna shall not exceed three meters (9.84 feet) in
diameter.
(5) Antennas
mounted on the roof a principal structure shall be so installed that
the highest portion of the antenna or related structural elements
or functional or other components and appurtenances thereto shall
not exceed the maximum height for principal structures in the district.
In addition, the maximum elevation of the antenna or components thereof
shall not exceed 10 feet above the existing roofline, provided that
said elevation does not exceed the height limitation of the district.
(6) Antennas
shall not be permitted to be mounted on accessory structures.
(7) Antennas
must comply with all setback requirements of the district in which
they are located.
(8) Antennas
shall be installed such that it is no closer than 2 1/2 times
the diameter of the dish portion of the antenna to any window of any
neighboring residential structure.
(9) No antenna
shall be located within the front yard setback of any property.
(10) Regardless
of location, antennas shall be installed only after issuance of a
building permit.
(11) No more
than one antenna shall be permitted on any lot in the Town of Webster.
(12) Antennas
shall meet all manufacturer's specifications, be of noncombustible
and corrosive-resistant material and be erected in a secure, wind-resistant
manner to the satisfaction of the Commissioner of Public Works or
his/her division heads, agents or designee.

(13) Every antenna
must be adequately grounded for protection against lightning.
(14) In all
districts in the Town of Webster, antennas shall be located and designed
to reduce visual impact from surrounding properties at street level,
from public streets and from windows, porches, decks and grounds of
nearby houses.
(15) Antennas
placed at ground level shall be screened from adjacent roads and structures
by an evergreen buffer, six feet in height at the time of planting,
which shall be maintained at all times in such a way as to screen
at least 75% of the visibility of the antenna.
