These rules and regulations shall be known as the "Sewer Use
Law - 2010." They supersede former Chapter 175, Local Law 2
of 1985.
The specific purposes of this chapter are the following:
A. To prevent the introduction of
substances into the POTW that will:
(1) Interfere with the POTW in
any way,
(2) Pass through the POTW to the
receiving waters and cause contravention of standards for those waters
or cause violation of the POTW's SPDES permit, or otherwise be incompatible
with the POTW,
(3) Increase the cost or otherwise
hamper the disposal of POTW sludge and/or residuals,
(4) Endanger the general public
or POTW personnel who may be effected by wastewater and sludge in
the course of their employment,
(5) Cause air pollution or groundwater
pollution, directly or indirectly,
(6) Cause, directly or indirectly,
any public nuisance condition.
B. To prohibit the contribution of
sewage and industrial wastes, and other wastes, which cause maintenance
difficulties in trunk sewers, force mains, pumping stations, sewage
regulators and other structures and appurtenances to the Town-wide
sewer system and public sewers tributary thereto.
C. To require the treatment before
introduction into the Sewer District's sewer system, local sewer collection
system and public sewers tributary thereto, of such wastes as may
otherwise impair the strength and/or durability of the structures
appurtenant to the system by direct or indirect chemical action, or
interfere with the normal collection and treatment process.
D. To prohibit excessive volumes
and/or inordinate rates of flow of sewage and wastes into the Town-wide
Sewer District's sewer system and/or local sewer collection system
and/or other public sewers tributary thereto.
E. To prevent new sources of infiltration
and inflow and, as much as possible, eliminate existing sources of
infiltration and inflow.
F. To assure that new sewers and
connections are properly constructed.
G. To provide for equitable distribution
to all users of the POTW of all costs associated with sewage transmission,
treatment and residual disposal, and to provide for the collection
of such costs.
H. To provide the authority and procedure
for the Town-wide Sewer District to promulgate rules, to investigate
and prepare findings and to issue licenses or permits, to hold hearings,
to make decisions, orders and opinions, and to give notice and make
public all rules and decisions.
I. To provide cooperation with the
Monroe County Department of Health, the New York State Department
of Environmental Conservation, the New York State Department of Health,
the United States Environmental Protection Agency, and other agencies
which have requirements of jurisdiction for the protection of the
physical, chemical, and bacteriological quality of watercourses within
or abounding the Town.
J. To protect the public health and
to prevent nuisances.
K. To improve the opportunity to
recycle and reclaim wastewater and sludge from the system.
All local laws and/or regulations of any local governing body
must be adhered to in addition to this chapter. This chapter will
supersede those laws and/or regulations only where conditions herein
are more stringent.
Except as otherwise provided herein, the Chief Plant Operator
and/or Superintendent of Sewers of the Town of Webster, New York,
or his/her duly authorized agent or representative, shall administer,
implement, and enforce the provisions of this chapter. Any powers
granted to or duties imposed upon the Chief Plant Operator and/or
Superintendent of Sewers may be delegated by the Chief Plant Operator
and/or Superintendent of Sewers to other Town of Webster Sewer Department
personnel.
