This article shall be entitled "A Local Law Abolishing Village Justice Position."
This article is enacted pursuant to the authority of Municipal Home Rule Law § 10 and Village Law.
It is the intent of the Village of Valatie Board of Trustees to abolish and terminate the position of the Village Justice pursuant to its authority under Village Law § 3-301(2)(a). The Board of Trustees has investigated the efficiencies and economies of abolishing the position of Village Justice, and finds that there would be substantial savings of Village resources by abolishing the position, and having all matters necessitating the services of the local justice court system, both civil and criminal, originating in the Village of Valatie handled in the justice court of the Town of Kinderhook.
The position of Village Justice be and the same hereby is abolished upon the expiration of the current term of the present Village Justice.
If any section or part of this article is declared invalid or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other section of this article.
This article shall take effect 30 days after adoption by the Village Board of Trustees or not until approved by an affirmative vote of a majority of the qualified electors of the Village, if within 30 days after adoption by the Village Board of Trustees there is filed with the Clerk of the Village a petition for referendum pursuant to the Village Law, Article 9, protesting this article and requesting that it be submitted to the electors of the Village for their approval or disapproval.
