No person shall obstruct the sidewalk or street with any article or substance, goods, wares or merchandise. "Obstruct" will be defined for the purposes of this article to mean to stop or impede movement through the street or sidewalk by obstacles or impediments, including any article or substance, goods, wares or merchandise. It shall be presumed that if any such obstacle or impediment is placed leaving less than three feet entirely free and clear of any such obstacle or impediment, the person so placing or allowing to be placed such impediment or obstacle and the owner of the premises adjacent to the sidewalk shall be deemed to be obstructing the sidewalk.
Any person erecting or repairing a building on or within 12 feet of the line of any street or sidewalk in said Village may, for a reasonable time while such building is being so erected or repaired, unless otherwise ordered by any one of the Trustees of said Village, use and occupy the street immediately in front of such building to one-third the width of such street on the side nearest to such building for storing materials and for other purposes directly connected with such building or repairing.

Upon service by certified mail of written notice to remove obstructions from sidewalks, the person so served shall remove or cause to be removed said obstructions within the time limit specified in said notice. Upon failure of the person so served to remove the obstructions, the Board of Trustees shall cause the removal of said obstruction and cause the cost and expense thereof to be assessed against the land upon which such obstruction exists, to be collected in the same manner as taxes.

No person shall occupy or use any street or erect any booth or platform thereon for the purpose of laying, opening or exposing for sale goods of any description without the consent of the Trustees, except that any person lawfully occupying the building adjacent to the sidewalk may occupy or use that portion of the sidewalk which does not cause the sidewalk to be obstructed as such term is defined in § 296-1 hereinabove without the consent of the Trustees, provided that the goods exposed, laid or opened are goods that are lawfully sold in the adjacent building, and further provided that such goods are so laid, opened or sold only during business hours in the building adjacent to the sidewalk.
