(a)
Definitions.
Every word and phrase used in this section
shall, for the purpose of this section, have the meaning ascribed
to them in the Texas Transportation Code, as amended or hereafter
amended.
(b)
Stop required.
The driver of a vehicle or motorcycle
upon any street or highway within the corporate limits of the city,
approaching a school bus from any direction, receiving and/or discharging
passengers, shall bring such vehicle or motorcycle to a full stop,
and the operator of such vehicle or motorcycle shall not start up
or attempt to pass in any direction until the school bus vehicle has
finished receiving and/or discharging its passengers.
(c)
School bus markings.
Every bus used for the transportation
of schoolchildren shall bear upon the front and rear thereon a plainly
visible sign containing the words “School Bus” in letters
not less than eight inches (8”) in height. When a school bus
is being operated upon a street or highway within the corporate limits
of the city for any purposes other than the actual transportation
of children either to or from school, all markings thereon indicating
“School Bus” shall be covered.

(a)
The city declares that it intends to enforce the provisions of House
Bill 55 which amends section 545.425 of the Transportation Code making
it an offense for an operator to operate a motor vehicle within a
school crossing zone while using a wireless communication device.
(b)
The public works department is instructed to post signs that comply
with the standards of section 545.425 of the Transportation Code at
the entrance to each school crossing zone within the city limits.
The city's enforcement shall commence on the effective date of the
amended section 545.425 of the Transportation Code, September 1, 2009.

No person shall drive a vehicle on any street in the city limits
at a speed greater than is reasonable and prudent under the conditions
and having regard to the actual and potential hazards then existing.
In every event, speed shall be so controlled as may be necessary to
avoid colliding with any person, vehicle or other conveyance on or
entering the highway in compliance with legal requirements, and it
shall be the duty of all persons to use due care. No person shall
operate or drive any motor vehicle or other vehicle within the corporate
limits of the city on any street at a greater speed than thirty (30)
miles per hour, unless signs are erected designating another speed
limit, or in any alley at a greater speed than fifteen (15) miles
per hour.

Whenever the city shall determine, upon the basis of an engineering
and/or traffic investigation, that the thirty (30) miles per hour
speed limit hereinbefore set forth is greater or less than is reasonable
or safe under the conditions found to exist at any intersection or
other place, or upon any part of the street or highway, the city shall
upon authorization by the city council by appropriate ordinance establish
such speed limit as shall be effective at all times when appropriate
signs giving notice thereof are erected at such intersection or other
place or part of the highway or street.

No person shall drive a motor vehicle at such a slow speed as
to impede the normal and reasonable movement of traffic, except when
reduced speed is necessary for safe operation, or in compliance with
law, or at the direction of a police officer. Police officers are
hereby authorized to enforce this provision by directions to drivers,
and in the event of apparent willful disobedience to this provision
and refusal to comply with the direction of an officer in accordance
herewith, the continued slow operation by a driver shall be a misdemeanor.

Speed limitations set forth in this division shall not apply
to an authorized emergency vehicle when responding to an emergency
call or when used in pursuit of an actual or suspected violator of
the law, or when responding to but not upon returning from a fire
alarm, and the driver thereof sounds audible signal by bell, siren
or exhaust whistle, and/or when such emergency vehicle is equipped
with at least one (1) lighted lamp exhibiting a red light visible
under normal atmospheric conditions from a distance of five hundred
feet (500’) to the front of such vehicle. This provision shall
not relieve the driver of an authorized emergency vehicle from the
duty to drive with due regard for the safety of all persons using
the street, nor shall it protect the driver of any such vehicle from
the consequences of a reckless disregard of the safety of others.

No person shall operate or drive a motor vehicle or other vehicle
upon the following described streets at a greater speed than the speed
designated for the street or portion of that street as set forth herein,
and any speed in excess of the limits set forth in this section shall
be prima facie evidence that such speed is neither reasonable nor
prudent and is unlawful.
(1)
U.S. Highway 90.
(A)
Maximum speed limits for U.S. Highway 90 shall be as follows:
(i)
Along U.S. 90 from the west city limit to 1690 feet east of Katy
West Road, a distance of approximately 0.593 miles, the speed limit
shall be 55 mph.
(ii)
Along U.S. 90 from 1690 feet east of Katy West Road to 158 feet
east of Carolina/Winchester, a distance of approximately 0.503 miles,
the speed limit shall be 45 mph.
(iii)
Along U.S. 90 from 158 feet east of Carolina/Winchester to the
centerline of Buffalo Bayou, a distance of approximately 0.620 miles,
the speed limit shall be 20 mph when flashing.
(iv)
Along U.S. 90 from centerline of Buffalo Bayou to the centerline
of Katy Fort Bend Road, a distance of approximately 1.24 miles, the
speed limit shall be 40 mph.
(B)
The public works department is authorized and directed to post and
maintain speed limit signs along U.S. Highway 90 within the city limits
displaying to vehicular traffic traveling such roads the speed limits
provided by this section.
(C)
Construction speed zone. A construction speed zone shall be established
along the named highway or part thereof described as follows:
(i)
Along I.H. 10 a/k/a U.S. 90 north and south frontage roads from the
Fort Bend/Harris County line to the eastern limits of the city, a
distance of approximately 0.784 mile, 40 mph.
(ii)
Along I.H. 10 a/k/a U.S. 90 main lanes from the Fort Bend/Harris
County line to the eastern limits of the city, a distance of approximately
0.784 miles, 55 mph.

Necessary signs for posting the speed zones will be furnished,
installed, and maintained by the direction of the state department
of transportation engineer in charge of the project.

(2)
FM 1463 (Richmond Road).
(A)
Along FM 1463 from the centerline of US 90, to a point 528 feet south
of the centerline of IH 10, a distance of approximately 0.79 miles,
the speed shall be 35 mph.
(B)
Along FM 1463, from a point 528 feet south of the centerline of IH
10 to the southern limit of the city, a distance of approximately
0.621 miles, the speed limit shall be 45 mph.
(C)
Along FM 1463 a school zone, from a point 317 feet south of the centerline
of US 90 to the point 1,373 feet south of the centerline of US 90,
a distance of approximately 0.200 miles, the speed limit shall be
20 mph when flashing.
(3)
George Bush Drive.
(A)
For traffic moving in both directions along George Bush Drive from
its intersection with Avenue D west to the east boundary line of the
park area owned by Katy Parks, Inc.: 10 mph.
(B)
The speed limit along such portion of George Bush Drive shall be
marked with speed limit signs, designating the maximum speed along
this street.
(4)
Avenue D and Katy-Hockley Road.
(A)
A maximum speed limit of thirty (30) miles per hour is established
and determined as the maximum reasonable speed for any vehicle traveling
along any portion of the following described streets:
(B)
The public works department is authorized and directed to post and
maintain speed limit signs along Avenue D and Katy-Hockley Road displaying
the speed limit provided by this subsection to vehicular traffic traveling
such roads.
(5)
Gardenia Lane.
(A)
A maximum speed limit of twenty (20) miles per hour is established
and determined as the maximum reasonable speed for any vehicle traveling
along any portion of Gardenia Lane from its intersection with Avenue
D east to its intersection with Avenue A.
(B)
The public works department is authorized and directed to post and
maintain speed limit signs along Gardenia Lane displaying the speed
limit provided by this subsection to vehicular traffic traveling such
road.
(6)
Katy City Park Road.
(A)
A maximum speed limit of twenty (20) miles per hour is established
and determined to be the maximum reasonable and prudent speed for
any vehicle traveling along any portion of Katy City Park Road between
its intersection with Franz Road and its intersection with Gardenia
Lane.
(B)
The public works department is authorized and directed to post and
maintain speed limit signs along Katy City Park Road displaying the
speed limit provided by this section to vehicular traffic traveling
on Katy City Park Road.
(7)
Kingsland Boulevard.
Along Kingsland Boulevard between
the east right-of-way line of Pin Oak Road and the west right-of-way
line of Katy Fort Bend Road, 30 mph.
(8)
Based on the engineering and traffic investigation, the prima facie
speed limit is hereby determined to be as prescribed by Texas Transportation
Code section 545.352(b)(1) on the following streets, to wit:
(A)
AMC Drive from its intersection with Katy Mills Circle to its intersection
with Kingsland Boulevard;
(B)
Bass Pro Drive from its intersection with Katy Mills Circle to its
intersection with I.H. 10 east frontage road;
(C)
Bell Patna Drive from its intersection with Katy Mills Circle to
its terminus;
(D)
Heritage Lane from its intersection with Katy Mills Circle to its
intersection with Kingsland Boulevard;
(E)
Katy Mills Boulevard from its intersection I.H. 10 east frontage
road to its intersection with Market Place Drive;
(F)
Katy Mills Circle, its entire circumference of Katy Mills Mall;
(G)
Katy Mills Drive from its intersection with Katy Mills Circle to
its intersection with Katy Fort Bend County Road;
(H)
Katy Mills Parkway from its intersection with Katy Mills Circle to
its intersection with Kingsland Boulevard;
(I)
Madison Drive from its intersection with Market Place Drive to its
intersection with Katy Mills Drive;
(J)
Market Place Drive from its intersection with Katy Mills Circle to
its intersection with Katy Fort Bend County Road;
(K)
Prairie Parkway from its intersection with Katy Mills Circle to its
intersection with Kingsland Boulevard;
(L)
Star Lane from its intersection with Katy Mills Circle to its intersection
with Katy Fort Bend County Road; and
(M)
Texmati Drive from its intersection with I.H. 10 east frontage road
to its intersection with Market Place Drive.
(9)
I.H. 10 frontage road.
Upon the basis of an engineering
and traffic investigation heretofore made as authorized by the provisions
of section 545.356, Texas Transportation Code, the following prima
facie speed limits hereafter indicated for vehicles are hereby determined
and declared to be reasonable and safe, and such speed limits are
hereby fixed at the rate of speed indicated for vehicles traveling
upon the named streets and highways, or parts thereof, described as
follows:
(A)
Along I.H. 10 south frontage road, west and east bound, from the
west city limits to the centerline of F.M. 1463, a distance of approximately
1.385 miles, shall be 50 mph.
(B)
Along I.H. 10 south frontage road, east bound, from the centerline
of F.M. 1463 to the east city limits, a distance of approximately
2.107 miles, shall be 50 mph.
(C)
Along I.H. 10 north frontage road, west and east bound, from centerline
of F.M. 1463 to a point of 2.577 feet west of the centerline of F.M.
1463, a distance of approximately 0.488 miles, shall be 50 mph.
(D)
Along I.H. 10 north frontage road, west bound, from the centerline
of F.M. 1463 to the east city limits, a distance of approximately
2.107 miles, shall be 50 mph.
(E)
Along Cane Island Parkway/bridge, a distance of approximately 432
feet; the speed limit shall be 25 mph.
(F)
Along I-10, main lane, from the west city limit, to the east city
limit, a distance of approximately 3.777 miles; the speed limit shall
be 50 mph.
(G)
Along I-10, north frontage road, from the 1663 feet west of FM 1463
to the east city limit, a distance of approximately 1.772 miles, the
speed limit shall be 50 mph.
(H)
Along I-10, south frontage road, from the east city limit to the
west city limit, a distance of approximately 3.777 miles, the speed
limit shall be 50 mph.
(10)
Pin Oak Road.
Upon the basis of an engineering and traffic
investigation heretofore made as authorized by the provisions of section
545.356, Texas Transportation Code, the following prima facie speed
limits hereafter indicated for vehicles are hereby determined and
declared to be reasonable and safe; and such speed limits are hereby
fixed at the rate of speed indicated for vehicles traveling upon the
named streets and highways, or parts thereof, described as follows:
(A)
Along Pin Oak Road from a point 375 feet to north of centerline of
the north frontage road of I-10 to a point 683 feet to south of the
centerline of the south frontage road of I-10 a distance of approximately
0.244 mile, the speed limit shall be 30 mph.
