The police department of the city shall make space available in the dispatching office for the installation of a signal panel to receive burglar and fire alarm signals from various business places in the city. The panel installed shall conform to such size specifications as determined by the chief of police, and shall be installed without cost to the city.

Subject to the conditions stated in this article, any business in the city shall be entitled to install an alarm signal in such panel upon the payment of an annual rental in the amount set forth in the fee schedule in appendix A of this code, paid in advance. Failure to pay such annual rental as due shall entitle the city to discontinue the service to such business place and remove the signal device from the panel.

Any business within the city is entitled to install signal devices in the panel at the sole cost of such business place. It shall be the duty and responsibility of the business user of such equipment to maintain such equipment in a good and sufficient operating condition. If any signal equipment shall fail to operate properly, or if it shall break or become inoperative, such signal device may be disconnected or removed from the circuit until the equipment is repaired and placed in proper condition.

(a) 
The above-mentioned service is being offered by the city to the business places in the city and under such conditions that any business place owner, office, or manager shall execute a full release of liability in favor of the city, agreeing to hold the city harmless from any claims, demands, loss or damages arising out of the use of such equipment, or the quality or condition thereof.

RELEASE OF LIABILITY
The undersigned, a business within the City of Katy, Texas, knows that the receiving equipment for the alarm system has been installed in the dispatching office of the Police Department of the City of Katy, Texas, and the undersigned hereby acknowledges that the City of Katy, Texas, is serving freely as an accommodation service to the undersigned; and that the City of Katy, Texas, shall never in any way be morally, financially or legally obligated to the undersigned for the operation of such system. The undersigned agrees to hold the City of Katy, Texas, harmless from any claims, demands, losses, or damages arising out of the operation of the system for the undersigned, and the City of Katy, Texas, is to be free from any and all liability of any type or description resulting from the operation of such system.
The undersigned executes this release as a requirement under Chapter 4, Article 4.03 of the City of Katy, Texas, Code of Ordinances in order to receive the service provided by the City of Katy, Texas, thereunder.
