For the purposes of this article, “smoke” or “smoking” shall mean the act of burning any tobacco product, weed, filler, plant of any kind or other combustible product in a cigarette, cigar, pipe, water pipe or in any other device.

Smoking is prohibited in the following city-owned buildings or portions of city-owned buildings:
(1) 
The social services building;
(2) 
The kitchen, restroom, classrooms and offices of the community building in Woodsland Park;
(3) 
All areas inside the VFW Hall;
(4) 
All buildings of the public works department, including the maintenance shop, white house and round top building;
(5) 
All areas of the police department;
(6) 
All areas of the city hall complex at 910 Avenue C;
(7) 
The library;
(8) 
The Scout building;
(9) 
City park buildings; and
(10) 
The fire station.
(11) 
Smoking is prohibited in the VFW Hall and Woodsland Park community building during all functions sponsored by the city.

(a) 
“Smoking Permitted” or “No Smoking” signs with letters of not less than one inch (1”) in height shall be conspicuously placed in every room, building or other place where smoking is prohibited or permitted.
(b) 
“No Smoking” signs with letters of not less than one inch in height shall be conspicuously placed in every room of the Katy VFW Hall.

(a) 
It shall be unlawful for any person to smoke or carry lighted tobacco products, weed, filler, plant of any kind or other combustible material in any form in any area within a city building designated “non-smoking.” Violation of this article shall be a misdemeanor.
(b) 
Any person found guilty of violating any provision of this article by smoking in an area designated “non-smoking” shall be fined as provided for in the general penalty provision found in section 1.01.009 of this code.
