(a)
A person who is younger than eighteen (18) years of age commits an offense if the person possesses, purchases or accepts receipt of a cigarette or other tobacco product.
(b)
This section shall not prohibit a person younger than eighteen (18) years of age from possessing a cigarette or other tobacco product while in the presence of a parent or legal guardian.
