It is the policy of the city, to the extent possible under applicable laws and ordinances and within budgetary limitations, for the officials, agents and employees of the city to cooperate with the Texas Commission on Environmental Quality in the air pollution control work of the state.

The building of fires and burning of trash, debris and other combustible materials within the limits of the city, in such a manner that any offensive smoke, odors, soot or ashes fall or are blown into and across surrounding property and buildings, shall be unlawful and shall constitute a nuisance, and any person who knowingly ignites and burns, or knowingly causes to be ignited and burned, or knowingly permits any person to ignite and burn any trash, debris or other combustible materials in such a manner that any offensive odors, smoke, soot or ashes therefrom fall upon or blow into and across surrounding property and buildings shall be guilty of a misdemeanor.
