(a) 
The public library of the city is recognized as a division of the city government and as a free public library available to the citizens of the city and supported by the annual budget of the city.
(b) 
The city manager and other officers of the city are directed to provide for the maintenance of the library, as well as its operation in the annual budget of the city.

(a) 
There is located in the new library building at the corner of Travis and Washington Streets a meeting room capable of accommodating approximately eighty (80) people. Such meeting room shall be used by the librarian under the direction of the city manager for the purpose of conducting a portion of the city’s library activities.
(b) 
The city manager and the librarian concurrently may establish rules and regulations not inconsistent with this section nor inconsistent with the library program, for the use of such room by the public in the furtherance of cultural, educational, and related library activities.
(c) 
Any public group may make application to the librarian for use of such room. Such application must be made at least fourteen (14) days in advance of the day it is to be used. Application forms will be available at the library.
(d) 
A use fee in the amount established by ordinance will be charged to any individual or organization which utilizes such room. Damages resulting from misuse shall be the sole responsibility of the user, reasonable wear and tear excepted. The use of such room shall be under the direction of the librarian.

(a) 
The city encourages gifts to the library system in the form of books, periodicals, pamphlets, equipment and money. No condition shall be imposed on any gift, except upon prior approval of the city manager and the librarian of the city.
(b) 
The city council delegates the primary responsibility for accepting gifts of equipment or fixtures to the city manager, and the city manager and librarian are authorized and delegated to make rules and regulations not in conflict herewith for the acceptance of such gifts.
(c) 
All donations will be acknowledged on forms provided by the city manager and the librarian and shall contain sufficient information for exemptions for federal income tax returns.

(a) 
A person commits an offense if he knowingly or recklessly fails to return any property, including but not limited to books, pamphlets, periodicals, papers, audio or visual recordings, works of art, or other property which has been borrowed from the city’s public library, within thirty (30) days after the property is due to be returned.
(b) 
The introduction into evidence of the original, or a true and correct copy, of the “book card” assigned to such property, bearing the due date for return of such property and bearing a library card number which was recorded on the book card when the property was checked out, is prima facie evidence that the person to whom such library card number is assigned, according to the records of the library, did borrow such property.
(c) 
The introduction into evidence of a copy of a written notice that any library property is overdue, together with evidence that such notice was deposited in the United States mail, postage prepaid, addressed to a person, is prima facie evidence that such person has knowledge that such property is overdue.
(d) 
The terms “book card” and “library card number” as used herein shall be given the following definitions:
(1) 
Book card shall mean the identifying card assigned to an item of property by the library staff for control purposes.
(2) 
Library card number shall mean the identifying number of the card issued to each patron of the library authorizing such person to check out library materials.

There is hereby established a board of seven (7) members, to be known as the Library Board of the City of Sherman. All members of the board shall have a knowledge of library affairs, a strong interest in library operations and a genuine appreciation of books.

(a) 
Members of the library board shall be appointed by the city council. Each appointment shall be for a term of three (3) years, and no member of the board shall serve more than three (3) three-year terms in succession.
(b) 
In the event of the death or resignation of a member of the board, the unexpired portion of his term shall be filled by appointment as herein specified.

The primary function of the library board shall be to serve in an advisory capacity with the librarian, city manager and the city council, but it is expressly provided that such functions shall be in an advisory capacity only, and the board shall have no authority to bind the city on any contract or agreement, and shall not interfere in any manner with the normal operations of the city.
