When requested by the city manager, all industrial users must submit information on the nature and characteristics of their wastewater by completing a wastewater survey prior to commencing their discharge. The city manager is authorized to prepare a form for this purpose and may periodically require industrial users to update the survey. Failure to complete this survey shall be reasonable grounds for terminating service to the industrial user and shall be considered a violation of this division.

In order to control the admission of industrial wastes into the public sewer, any person within or without the corporate limits of the city desiring to discharge an industrial waste mixture into the sewers or POTW of the city, or any sewer connected therewith, shall make an application to the city upon application forms to be obtained from the city manager.

(a) 
It shall be unlawful for any significant industrial user to discharge wastewater into the city's POTW without first obtaining a wastewater discharge permit from the city manager. Any violation of the terms and conditions of a wastewater discharge permit shall be deemed a violation of this division and subjects the wastewater discharge permittee to the sanctions set out in parts X and XI, below. Obtaining a wastewater discharge permit does not relieve a permittee of its obligation to comply with all federal and state pretreatment standards or requirements or with any other requirements of federal, state and local law.
(b) 
The city manager may require other industrial users, including liquid waste haulers, to obtain wastewater discharge permits as necessary to carry out the purpose of this division.
(c) 
The city manager may determine if pretreatment facilities are adequate for efficient treatment of discharged waste.
(d) 
The city manager may issue a wastewater discharge permit if it is determined that an applicant is not discharging waste in violation of section 13.07.352, other than BOD, TSS or FOG.

Any significant industrial user which discharges waste into the POTW prior to the effective date of this division and who wishes to continue such discharges in the future shall, within ninety (90) days after said date, apply to the city for a wastewater discharge permit in accordance with section 13.07.432 below, and shall not cause or allow discharges to the POTW to continue after one hundred twenty (120) days of the effective date of this division except in accordance with a wastewater discharge permit issued by the city manager.

Any significant industrial user proposing to begin or recommence discharging industrial wastes into the POTW must obtain a wastewater discharge permit prior to the beginning or recommencing of such discharge. An application for this wastewater discharge permit must be filed at least ninety (90) days prior to the date upon which any discharge will begin or recommence, unless the city manager has given expressed written permission otherwise.

(a) 
If another municipality, or user located within another municipality, contributes wastewater to the POTW, the city manager shall enter into an interlocal agreement with the contributing municipality.
(b) 
Any existing significant industrial user located beyond the city limits shall submit a wastewater discharge permit application, in accordance with section 13.07.432 below, within ninety (90) days of the effective date of this division. New significant industrial users located beyond the city limits shall submit such applications to the city manager ninety (90) days prior to the date upon which any discharge will begin or recommence, unless the city manager has given expressed written permission otherwise.

(a) 
In order to be considered for a wastewater discharge permit, all industrial users required to have a wastewater discharge permit must submit the information required by section 13.07.462. The city manager shall approve a form to be used as a permit application. In addition, the following information may be requested:
(1) 
Name and title of IU official.
(2) 
List of any of the IU’s other previous environmental permits.
(3) 
The date IU commenced discharge to the city.
(4) 
Date of receipt of baseline monitoring report (BMR).
(5) 
Date of receipt of 90-day report for categorical industrial users (CIU’s).
(6) 
A certification by the IU in lieu of monitoring, or the requirement to perform total toxic organic (TTO) monitoring where applicable.
(7) 
A submittal of a toxic organic management plan (TOMP) or other management plan.
(8) 
Any planned changes in the production rate by the IU in the future.
(9) 
Identification of sources of discharges, such as regulated, dilution flow, noncontact flows.
(10) 
Applicability of combined wastestream formula to derive alternative pollutant limits.
(11) 
Estimation or measurement of process and nonprocess flows.
(12) 
Identification of types of discharges such as continuous or batch discharge.
(13) 
Submittal of slug control plan as required under 40 CFR 403.8(9(2)(v).
(14) 
A list of hazardous waste(s) and description of any storage areas for these hazardous waste(s).
(15) 
Description of activities, facilities, and plant processes on the premises, including a list of all raw materials and chemicals used or stored at the facility which are, or could accidentally or intentionally be, discharged to the POTW.
(16) 
Number and type of employees, hours of operation, and proposed or actual hours of discharge to the POTW.
(17) 
Each product produced by type, amount, processes, and rate of production.
(18) 
Type and amount of raw materials processed (average and maximum per day).
(19) 
The site plans, floor drains, and appurtenances by size, location, and elevation, and all points of discharge.
(20) 
Time and duration of the discharge.
(21) 
Any other pertinent information as may be deemed necessary by the city manager to evaluate the wastewater discharge permit application.
(b) 
A permittee shall comply with all requirements or agreements or arrangements, including but not limited to provisions for:
(1) 
Payment of charges or fees;
(2) 
Installation and operation of pretreatment facilities;
(3) 
Sampling and analysis to determine quality and quantity of wastewater; and
(4) 
Providing a sampling point subject to the provisions of this division and approval of the city.
(c) 
Incomplete or inaccurate applications will not be processed and will be returned to the industrial user for revision.

(a) 
All wastewater discharge permit applications and industrial user reports required by this division must contain the following certification statement, with a printed and signed name of an authorized representative of the industrial user:
“I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the information, the information submitted is to the best of my knowledge and belief true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for knowing violations.”
(b) 
The authorized representative shall be identified in a written authorization statement submitted to the control authority. Such authorization must specify either an individual or a position having responsibility for the overall operation of the facility from which the industrial discharge originates, such as the position of plant manager, operator of a well, or well field superintendent, or a position of equivalent responsibility, or having overall responsibility for environmental matters for the company. If an authorization is no longer accurate because a different individual or position has responsibility for the overall operation of the facility, or overall responsibility for environmental matters for the company, a new authorization satisfying the requirements must be submitted to the control authority prior to or together with any reports to be signed by an authorized representative.

(a) 
The city will evaluate the data furnished by the industrial user and may require additional information. Within ninety (90) days of receipt of a complete wastewater discharge permit application, the city manager will determine whether or not to issue a wastewater discharge permit. If no determination is made within this time period, the application will be deemed denied. The city manager may deny any application for a wastewater discharge permit.
(b) 
Appeals of such action or inaction by the city manager are subject to the provisions of section 13.07.463.
