(a) The
city council adopts the International Fire Code, 2021 edition, as
published by the International Code Council and its appendices. Specifically,
NFPA 4.09, as it relates only to aviation and airports, supersedes
the NCTCOG Regional Amendments below and is hereby adopted, a copy
of which is located on the city building department website.
(b) The
city council adopts the NCTCOG 2021 regional amendments option B to
the International Fire Code, 2021 edition, a copy of which is located
on the North Central Texas Council of Governments website.

(a) The
term “jurisdiction” as used in the International Fire
Code shall refer to the corporate city limits of the city.
(b) The
term “chief of the bureau of fire prevention” shall refer
to the fire inspector.
(c) All
references to the “chief” or “his authorized representative”
in the International Fire Code when used in reference to the enforcement
of this code shall refer to the fire inspector.

(a) The
city’s fire code shall be enforced by the fire inspector’s
office of the city, which is hereby established and which shall be
operated under the supervision of the city manager or his/her designee.
The fire inspector shall report to the city manager or his/her designee.
(b) The
fire inspector shall be in charge of the fire inspector’s office
and shall be appointed by the city manager or his/her designee.
(c) The
fire inspector shall recommend to the city manager or his/her designee
any changes or amendments to the fire code which, in his judgment,
shall be desirable.

It shall be unlawful for any person to possess, store, offer
for sale, expose for sale, sell at retail, use or explode any fireworks
within the corporate city limits of the city or within five thousand
feet (5,000') of the city limits.

The storage of flammable or combustible liquids in outside aboveground
tanks is prohibited in all areas within the corporate city limits
except for those areas zoned industrial and then only on sites specifically
approved by the fire inspector.

The storage of liquefied petroleum gas in the corporate city
limits of the city shall be limited and restricted in conformity with
the provisions of the International Fire Code and the city’s
comprehensive zoning ordinance.

(a) The
city adopts the NCTCOG Regional Amendments “option B,”
to the adopted fire code, as maintained on file in the city secretary’s
office.
(b) For the purpose of this chapter, the duties of the board of appeals in section 108 of the International Fire Code shall be delegated to the city’s building standards, plumbing, adjustments and appeals board, which board shall have the authority set out in article
3.03 of this code.
