There is hereby created a permanent trust fund committee for the city, to be known as the San Benito-Falligant Milk Fund and Health Fund Committee. Said committee consists of three (3) women members, with the mayor of the city serving as an ex officio member of the committee. The term of appointment of the members of said committee shall be for staggered three-year periods. In the event of a vacancy on the committee, the mayor may appoint a new member or members of the committee to fill the unexpired term or terms. In the event the mayor fails to appoint new members to the committee upon termination of the term of the existing members, the existing members of the committee shall continue to hold office until new members have been appointed.

(a) 
The committee herein created shall receive and be responsible for the disbursement of the income derived from the George B. Falligant Milk Fund Trust. The committee shall expend the income derived from such milk fund trust for the purchase of sweet milk to be dispensed to the needy children of the city, under such regulations and conditions as such committee and the Houston Bank and Trust Company, as trustee, may agree upon.
(b) 
The committee herein created shall also receive and be responsible for the disbursement of income derived from the George B. Falligant Health Fund Trust. The committee shall expend the income derived from such health fund trust in any way that will help the children of the city, who are of school age, to become healthier and better children, morally, mentally and physically. It is specifically provided, however, that no part of the income from this health trust fund shall be used for surgical operations of any sort whatsoever, but shall be used for clothing and the like, for dispensing natural foods to needy children, for physical examinations, for lectures to the parents of school age children, and other similar purposes.

(a) 
The San Benito-Falligant Milk Fund and Health Fund Committee created is directed to carry out and comply with the purposes for which it is created.
(b) 
The committee shall make an annual accounting to the city commission, which accounting shall set out in detail the funds received for the milk fund and the health fund and the expenditures made by the committee for each fund during the preceding year, said accounting to be in form acceptable to the Houston Bank and Trust Company, as trustee. The city shall furnish the Houston Bank and Trust Company with a certified copy of such accounting.
(c) 
The Houston Bank and Trust Company, as trustee, reserves the right, in its absolute discretion, to determine if the income from the milk fund trust is no longer needed, or if the income from the health fund trust is not being used by the committee for the purposes herein set forth.
(d) 
The city shall maintain two (2) bank accounts, designated as the “San Benito-Falligant Milk Fund Trust” and the “San Benito-Falligant Health Fund Trust,” into which funds received from the Houston Bank and Trust Company, as trustee, shall be deposited.
(e) 
In the event there remains on hand at the end of each accounting period unexpended funds for the year, such unexpended funds shall be carried over to the succeeding year and disbursed together with any additional funds received from the trustee and may be carried over from year to year and expended at one or more times, in such amounts as the committee deems such expenditure advisable and beneficial for the children of the city in accordance with the provisions of the trust instrument.
