Bin.
Metal receptacle designed to be lifted and emptied mechanically for use only at commercial and industrial units.
Brush.
Tree trimmings, grass cuttings, dead trees or branches thereof, shrubs, chips shavings.
Bulky waste.
Appliances such as washers, dryers, stoves, air conditioners and refrigerators (provided Freon has been removed by a licensed facility and is labeled as such), water tanks, furniture, and mattresses.
City.
City of San Benito, Texas.
Commercial and industrial refuse.
All bulky waste, construction debris, garbage, and rubbish and stable matter generated by a customer or contractor at a commercial and industrial unit.
Commercial and industrial unit.
All premises locations or entities, public or private requiring refuse collection within the corporation limits of the city not a residential unit.
Construction debris.
Waste building materials resulting from commercial, industrial, or residential construction, remodeling, repair or demolition operations.
Containers.
96 gallon garbage carts for residential use, to be provided by contractor, to be used in conjunction with a fully authorized pickup plan.
Contract documents.
Contractor’s proposal, general specifications, the contract and any addenda or changes to the foregoing documents agreed to by the city and the contractor. Contract documents shall include the following documents, and this contract does hereby expressly incorporate it herein as fully as is set forth verbatim in this contract:
(1) 
This instrument;
(2) 
The contractor’s;
(3) 
The general specifications;
(4) 
The resolution of the City of San Benito ordering or authorizing the work and services contemplated herein;
(5) 
Any addenda or change to the foregoing documents agreed to by the parties hereto.
Contractor.
is the corporation performing refuse collection and disposal under contract with the City.
Customer.
An occupant of a commercial and industrial unit or a residential unit who generates refuse.
Dead animals.
Animals or portions thereof equal to or greater than 10 pounds in weight that have expired from any cause, except those slaughtered or killed for human use.
Disposal site.
A refuse depository, physically located in the city or in close proximity thereto including but not limited to sanitary landfills, transfer stations, incinerators, and waste processing/separation centers licensed, permitted or approved to receive for processing or final disposal of refuse and dead animals by all governmental bodies and agencies having jurisdiction and requiring such licenses, permits or approvals.
Excluded waste.
See section 5.03 of contract for solid waste collection and disposal service between the City of San Benito, Texas, and BFI Waste Services of Texas, L.P.
Garbage.
Any and all dead animals of less than 10 pounds in weight, except those slaughtered for human consumption; every accumulation of waste (animal, vegetable and/or other matter) that results from the preparation, processing, consumption dealing in, handling, packing, canning, storage, transportation, decay or decomposition of meats, fish, fowl, birds, fruits, but not by way of limitation, used tin cans and other decomposable waste animal or vegetable matter which is likely to attract flies or rodents); except (in all cases) any matter included in the definition of bulky waste, construction debris, dead animals, hazardous waste, rubbish or stable matter.
Hazardous waste.
Waste, in any amount, which is defined, characterized or designated as hazardous by the United States Environmental Protection Agency or appropriate state agency by or pursuant to federal or state law, or waste, in any amount, which is regulated under federal or state law. For purposes of this contract, the term hazardous waste shall also include motor oil, gasoline, paint and paint cans.
Landfill.
A lawfully permitted sanitary landfill of the contractor’s selection.
Refuse.
Residential refuse, commercial and industrial refuse, brush/bulky items, construction debris and stable matter generated by a customer or contractor.
Residential refuse.
All garbage and rubbish generated by a customer or contractor at a residential unit who generates refuse.
Residential unit.
A dwelling within the corporate limits of the city occupied by a person or group of persons comprising not more than four families. A residential unit shall be deemed occupied when water services are being supplied thereto. A condominium dwelling, whether single or multi-level construction, consisting of four or less contiguous or separate single-family dwelling within any such residential unit shall be treated as a residential unit, except that each single-family dwelling within any such residential unit.
Rubbish.
See bulky waste.
Special waste.
Special waste is any nonhazardous solid waste which, because of its physical characteristics, chemical make-up, or biological nature requires either special handling, disposal procedures including liquids for solidification at the landfill, documentation, and/or regulatory authorization, or poses an unusual threat to human health, equipment, property, or the environment. Special waste must conform in all respects with a contractor-approved special waste profile. Special waste that does not conform to the special waste profile is considered excluded waste.
Special waste profile.
Contractor’s form of documentation that the city must complete, and contractor must approve, with respect to any special waste prior to contractor’s acceptance of such special waste.
Stable matter.
All manure and other waste matter normally accumulated in or about a stable, or any animal, livestock or poultry enclosure, and resulting from the keeping of animals, poultry or livestock.

All subscribers to solid waste collection and disposal services shall submit to the following rates:
(1) 
Residential single-family rate - automated.
Rate schedule as set by the current contract with the service provider.
(A) 
All residential units shall subscribe to solid waste collection and disposal services as provided by the city or its contractor.
(B) 
All solid waste to be picked up must be placed inside container provided by the city or its contractor.
(C) 
Pick up frequency shall be twice per week.
(D) 
A single-family residence may request additional containers at an additional cost as set by the current contract with the service provider.
(2) 
Multi-unit rate - automated.
Rate schedule as set by the current contract with the service provider.
(A) 
All multi-unit customers with more than 2 units shall subscribe to solid waste collection and disposal services as provided by the city or its contractor.
(B) 
A multi-unit customer may request additional containers at an additional cost as set by the current contract with the service provider.
(3) 
Commercial rate - automated.
Rate schedule as set by the current contract with the service provider.
(A) 
All commercial customers shall subscribe to solid waste collection and disposal services as provided by the city or its contractor.
(B) 
All solid waste to be picked up must be placed inside container provided by the city or its contractor.
(C) 
Pick up frequency shall be twice per week.
(D) 
Overflow fee will be charged for overflowing containers.
(4) 
Commercial - bins.
Accounts past due over 15 days from the billing date of the utility bill will be picked up and the account will be charged a $25.00 service fee. An additional $25.00 service fee for re-delivery will be charged when full payment has been collected on the account. Commercial accounts will also be subject to a ten percent late charge. Commercial bin service for solid waste as necessitated by volume of waste produced or by request of the customer shall comply with the rate schedule as set by the current contract with the service provider.
(5) 
Exclusive contract.
The contractor shall have the sole and exclusive franchise, license, and privilege to provide residential, commercial, industrial, and construction refuse collection, removal and disposal services within the corporate limits of the city. The contractor shall at all times have the right of first refusal to the collection of hazardous waste from residential, commercial and industrial units, including demolitions, abatements and other material.

(a) 
In accordance with Texas Water Code section 13.807, the city will determine the rates for utility services to nonsubmetered master metered recreational vehicle parks on the same basis as those for commercial businesses, including hotels and motels, which serve transient customers and receive nonsubmetered master metered utility services from the city. The following provisions apply to mobile home/recreational vehicle parks that have rental sites available for use by recreational vehicles and by other types of vehicles or dwellings.
(b) 
Per section 13.087 [of the Texas Water Code], the following definitions apply:
Recreational vehicle.
Includes a “house trailer” as that term is defined by section 501.002, Texas Transportation Code; and “towable recreational vehicle” as that term is defined by section 541.201, Texas Transportation Code:
(1) 
House trailer.
A trailer designed for human habitation.
(2) 
Towable recreational vehicle.
A nonmotorized vehicle that is designed to be towable by a motor vehicle; and for temporary human habitation for uses including recreational camping or seasonal use; is permanently built on a single chassis; may contain one or more life-support systems and may be used permanently or temporarily for advertising, selling, displaying, or promoting merchandise or services, but is not used for transporting property for hire or for distribution by a private carrier.
Recreational vehicle park.
A commercial property on which connections are made for recreational vehicle transient guest use and for which fees are paid at intervals of one day or longer.
(c) 
Sites at MH/RV parks that have dwellings or vehicles falling outside the scope of Texas Water Code section 13.087 will be deemed “qualifying dwellings” and will be assessed a $5.00 surcharge for water and a $5.00 surcharge for sanitary sewer services provided, per month for each occupied site.
(d) 
For purposes of determining the total number of qualifying dwellings (as defined above) within each park, the city has elected to adopt the definition of certain “qualifying dwellings” falling outside the scope of Texas House Bill 841 as applied by the county appraisal district. Each year in January, the utility department will obtain from the county appraisal district the tax roll of qualifying dwellings (as defined above) within each MH/RV park. This tax roll will be used for the purpose of establishing a base for the number of possible qualifying dwellings for each year’s fiscal surcharges at each MH/RV park.
(e) 
The city will assess a monthly surcharge to MH/RV park accounts based on the number of occupied qualifying dwellings reported to the city by MH/RV park management. In certain cases, the city may provide water or sanitary sewer services, but not both, to its customers. MH/RV park surcharges will be billed based on the actual services provided.
(f) 
MH/RV parks will be required to enter into an agreement, in the format as illustrated in appendix A to Ordinance 2409H, for the purpose of reporting to the city the number of qualifying dwelling spaces that are actually used by or exclusively available for use by “recreational vehicles” on a transient basis, as the term is defined by section 13.087 of the Texas Water Code.
(g) 
MH/RV parks will be required to submit monthly rent rolls, in the format as illustrated in appendix B to Ordinance 2409H, for the purpose of reporting to the city the actual number of qualifying dwelling sites or spaces that are rented for the month(s) requested.
(h) 
MH/RV park rent rolls will be submitted to the city’s utility department no later than 10 days before the billing cycle as described below. Rent rolls must reflect actual occupied qualifying dwelling sites or spaces for the preceding 30-day period and must include all qualifying dwelling sites or spaces rented during the period.

(i) 
In situations where the rent roll due date falls on a weekend or holiday the rent roll will be due no later than the following Monday or business day.
(j) 
The utility department will perform periodic random audits of the rent rolls through visual count and evaluation of MH/RV park records to confirm the information reported. MH/RV park management will be required to assist the utility department in determining the nature of, or reason(s) for, differences identified between the audit and information reported in the rent roll.
(k) 
The results of the audit will be compared and reconciled to the rent rolls provided and any unexplained variances will be considered a violation of this section and theft of services.
(l) 
In the event that that it is determined that a violation of this section has occurred, the city will assess and the MH/RV park will pay for the following twelve months the surcharge based on the total number of qualifying rental spaces last provided by the city’s last audit results.
(m) 
In the event of any subsequent unexplained differences between audited amounts and those reflected in the rent roll, the city will assess and the MH/RV park will thereafter permanently pay a surcharge based on the total number of qualifying spaces provided by the city’s last audit results.

(a) 
Utility bills for residential and commercial accounts, mailed for water, sewer, refuse and brush services, shall be considered due upon the date of receipt, which shall be presumed to be two days following the date of the utility bill.
(b) 
A residential and/or commercial account shall be considered past due by the city when full payment on the account has not been paid by 5:00 p.m. on the 10th day following the date of the utility bill. On this date, a penalty of $10.00 or (10%), whichever is greater, will be incurred on the unpaid balance. This penalty will not be imposed on senior citizens or legally physically handicapped account holders.
(1) 
Past due inactive and finalized accounts will be reviewed and compared to determine whether a current account or accounts exist for services under the same customer name. In cases where it is determined that past due inactive and finalized accounts are held by the same individual or business, the city will transfer the past due amounts to the active account and require payment in full of the past due amounts or services will be terminated.
(2) 
On the following business day, the city shall mail a delinquent notice to the customer of its intention to disconnect service five (5) days thereafter. Service shall be disconnected if the utility bill is not paid in full by the 15th day following the date of the utility bill.
(c) 
Service shall be reconnected when the balance of the account and reconnect fees of $30.00 have been paid in full. Service of an account paid in full on or before 3:00 p.m. shall be reconnected by the city on the same day. Customers on reconnect list will be required to upgrade their deposit to the current rate. A fifteen dollar ($15.00) penalty apart from other late penalties will be assessed to customers who pay their water bill while their services are in the process of being disconnected but have not been disconnected at the time payment is made.
(d) 
(1) 
Customer deposits are held as long as the customer’s account is active. Upon request to terminate services, a final reading will be taken. The deposit will be applied toward payment of the final billing. Any remaining balance will be refunded to the customer by check from the finance department and mailed to the forwarding address submitted on the disconnection request.
(2) 
In the event that the utility or finance department is notified by the customer that a refund check has not been received; the following procedures will apply:
(A) 
Finance or utility department staff will notify the customer that the replacement check will not be issued for 15 days beginning on the date the notification is made.
(B) 
The finance department will submit a stop payment request for that check to the city’s depository.
(C) 
Replacement refund checks will be issued in the normal course of business following the 15th day that notification was made.

(a) 
Service of an account paid in full after 3:00 p.m. shall be reconnected the following working day between the hours of 8:00 a.m. and 5:00 p.m. A request to reconnect services during the weekend or after 3:00 p.m. shall be accepted if the customer agrees in writing to pay an additional $15.00 service fee. If service request occurs after hours or on weekends, written documentation of services reconnected by city personnel shall be submitted to the utility billing office by 8:30 a.m. on the next regular business day.
(b) 
If payment from customer is not received by 9:00 a.m. on that next regular business day, services shall again be disconnected by the city and an additional reconnect fee will apply with no reconnection of water services made until full and complete payment is received.

A service disconnected because of nonpayment shall be secured with a locking device whenever possible. Tampering with the locking device shall result in a one hundred dollar ($100.00) tampering fee added to the account of the customer. It shall be unlawful for any person to tamper with, destroy, disable, damage, or otherwise alter any locking device securing a water meter. Any person violating this section shall, upon conviction thereof, be subject to a fine of not less than one hundred and no/100th dollars ($100.00) nor more than five hundred dollars ($500.00) per violation each day such violation shall occur shall constitute a separate violation subject to penalty.

(a) 
All situations involving direct connections will be immediately reported to the police department for investigation. Direct connections refers to the water line being or having been directly connected to the service connection (or private water line) of the customer without a metering device.
(b) 
It shall be unlawful for any person to connect a private water line to a public water line or to some other person’s private water line without a metering device in place approved by the city. Any person violating this section shall, upon conviction thereof, be subject to a fine of not less than one hundred and no/100th dollars ($100.00) nor more than five hundred dollars ($500.00) per violation each day such violation shall occur shall constitute a separate violation subject to penalty.

A property owner, landlord, and/or tenant who rents either residences, houses and/or apartments shall be required to submit to the city a written lease agreement before water service is connected or reconnected. The tenant shall agree to be responsible for any unpaid balance left by such tenant.

Landlords shall be permitted to temporarily connect water service to rental property for usage of up to 2,000 gallons if a temporary connection fee of $50.00 is paid. Water services for a temporary connection shall not exceed five (5) working days.

Customers who are senior citizens (65 or older) and/or legally physically handicapped and live on Social Security Income (SSI) only, who provide proof of age as well as pertinent documentation as may be required by the city, may be permitted to pay the utility bill in full at the beginning of the month, not later than the fifth (5th) day of every month. Periodically, the city will update the account information for senior citizens to determine whether they continue to occupy the current service address.

The city may grant one (1) extension per year to a customer’s utility account for unforeseen circumstances. The extension shall be requested before the cut-off date, and the customer shall be required to complete an agreement, specifying when full payment on account shall be made. The agreement will be entered into the city’s utility billing system.

If a reading of a water meter is found to be in error, the account will be adjusted accordingly. Adjustments will be calculated by the utility billing supervisor and approved by the finance director. The finance director will report adjustments to the city manager. This adjustment will be determined by calculating the previous six months (6) usage and arriving at an average. In cases where other errors are found attributable to a responsibility of the city, billing adjustments will be evaluated and approved under the same process.

A property where a defaulted account has been left by an occupant will not have water services connected until that account has been cleared.

The U.S. Environmental Protection Agency (EPA) issued regulations in 1999 to protect stormwater quality in small cities and urbanized areas. In Texas, the Texas Commission on Environmental Quality (TCEQ) was delegated the responsibility for implementing the regulations, commonly called the phase II stormwater program.

The city is one of several hundred cities, counties, and other public entities required to develop a program to protect stormwater quality under phase II regulations.

The EPA required the TCEQ to develop stormwater quality permit conditions for regulated public entities such as the city by December 9, 2002. The TCEQ finalized the permit August 13, 2007, and the city was required to develop and submit to the TCEQ a plan for a stormwater quality management program by February 11, 2008.
(d) 
The purpose of the phase II stormwater program is to improve water quality in rivers, streams and lakes by controlling the runoff of pollutants from construction sites and developed property. Pollutants include sediment from soil erosion, nutrients from fertilizers, chemicals from the treatment of lawns, garbage and floatables from parking lots and streets, and the discharge of industrial pollutants.
(e) 
EPA regulations require the best management practices (BMP’s) be implemented by August 2012 to address six minimum control measures that will improve stormwater quality. The minimum control measures are public education and outreach, public participation and involvement, illicit discharge detection and elimination, construction site runoff control, post-construction runoff control, and pollution prevention and good housekeeping at municipal facilities. Measureable goals must be identified for the BMP’s and progress on each must be reported annually to TCEQ.
(f) 
The city has developed a stormwater management plan (SWMP) to comply with the requirements of the Texas Pollutant Discharge Elimination System (TPDES) General Permit No. TXR040000. The SWMP includes best management practices (BMPs) that will be implemented by the City to reduce stormwater pollution to the “maximum extent practicable,” as regulations require.
(g) 
In order to meet the additional costs related to compliance with this mandate, the city will assess a monthly surcharge of $1.50 and $2.75 to residential and commercial utility customers, respectively. For purposes of classification, multi-unit customers will be included within the commercial category. The surcharge will be charged and collected through the city’s utility billing system.
