The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Fence.
A chain-link fence at least six feet high entirely enclosing the storage facility and having at least one locking gate to enable the lessees of the facility to access their personal property.
Storage facility.
A commercial establishment having more than 20 separate, locked storage areas whereby, for consideration, a person leases space in a portion of the structure for the storage of personal property items, excluding boats, airplanes and motor vehicles.

(a) 
Penalty.
Any person violating any of the provisions of this article shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in a sum not to exceed $500.00 for each offense, and every day an offense occurs or continues shall constitute a separate offense.
(b) 
Civil remedies.
In case of any willful violation of any of the terms or provisions of this article, the city, in addition to imposing the penalties provided in subsection (a) of this section, and any person leasing space in a storage facility, may institute any appropriate action or proceeding in any court having proper jurisdiction to restrain, correct or abate such violations, and the filing of criminal charges shall not preclude the city or any other person from invoking the civil remedies provided in this subsection, but the same shall be cumulative and subject to prosecution as prescribed in this section for such violations.

All owners or operators of storage facilities within the city shall erect and maintain a fence enclosing the facility. The fence shall have a locked gate which shall be locked between the hours of 10:00 p.m. and 8:00 a.m., Monday through Sunday, including holidays. All persons who lease space in the storage facility shall be provided keys to the gate by the owner or operator of the storage facility.

All owners or operators of storage facilities within the city shall erect and maintain lights of a sufficient brightness so that they illuminate the premises of the storage facility during nighttime hours.
