Any person violating any of the provisions or terms of this chapter shall be deemed guilty of a misdemeanor and, upon conviction, be punished by a fine not to exceed the sum of $2,000.00 for each offense, and each and every day such violation shall continue shall be deemed to constitute a separate offense. Allegation and evidence of a culpable mental state is not required for proof of any offense defined by this chapter.

In order to hear and to decide appeals of orders, decisions or determinations made by the building official relative to the application and interpretation of any code referenced in this chapter, there shall be and is hereby created a board of appeals consisting of the members of the zoning board of adjustment and who are not employees of the city. The building official shall be an ex officio member of and shall act as secretary to such board but shall have no vote on any matter before the board. The board of appeals shall be appointed by the governing body and shall hold office at its pleasure. The board shall adopt rules of procedure for conducting its business, and shall render all decisions and findings in writing to the appellant with a duplicate copy to the building official.

(a) 
Prior to performing any work on any property within the city which requires a permit be issued pursuant to this chapter, a person must register as a contractor with the building inspections department.
(b) 
Upon completion of registration as provided in subsection (a) of this section and payment of the applicable fee, the person shall be authorized to make application for and obtain permits from the city pursuant to this chapter for a period of one (1) year from the date of issuance of the registration certificate by the building inspections department.
(c) 
Registration as a contractor pursuant to this section shall be on forms approved by the chief building official and shall be accompanied by a non-refundable fee payable to the city in the amount set forth in the city's official fee schedule maintained in the office of the city secretary, which fee may be amended from time to time by resolution of the city council.

The fee charged for all fence permits shall be according to the valuation of the fence at $10.00 per linear foot. See the fee schedule in table 3A [1-A], referred to in section 23.01.001(a)(1). Fees shall be paid prior to any work being commenced.
