[HISTORY: Adopted by the Town Board of the Town of East Greenbush 4-23-1957 (Ch. 22 of the 1991 Code). Amendments noted where applicable.]
As used herein and for enforcement hereof, the following terms shall have the meanings indicated:
BOARD
The Town Board of the Town of East Greenbush.
PARK
Any and all lands presently held by the Town of East Greenbush or any of its political subdivisions, which lands have previously been designated by the Town Board of the Town of East Greenbush as a "park," "parks," "parkland" or "park area," and, further, any land hereinafter acquired by said Town of East Greenbush and so designated, together with all land, public rights-of-way, easements, riparian rights, land under water or other rights of tenancy, use or access adjacent or pertaining thereto, and wherein such rights or title are held by or vested in the Town of East Greenbush. Any such park, parks, parkland or park area shall be a Town park as authorized by Subdivision 3 of § 220 of the Town Law.

Parks within the Town of East Greenbush include the following: Town Park, Onderdonk Park, Woodland Park and Hampton Manor Beach House.

The use of power-propelled and nonmotorized boats of any kind is prohibited in the park. Privately owned boats of any nature are prohibited in the park except under permit.
A. 
No person shall bathe, wade or swim in the waters of the parks except in such areas as are designated as bathing areas and in such season and at such times as the Board may, by resolution, establish and unless properly garbed in bathing suit or similar garment which shall be suitable for the use intended and which shall prevent any indecent exposure of the person; nor in any manner contrary to the instructions of lifeguards or supervisors stationed at such designated areas.[1]

B. 
No person shall enter designated bathing areas except at duly established access points thereof.
The Board may, by appropriate resolution, establish the hours of the day, the days of the week and the season or portion of the year during which supervised bathing or other uses will be permitted; and such uses of the park at other times will be a violation of these rules and regulations.
A. 
No person shall deposit trash, garbage, rubbish or otherwise cast or distribute any litter on any part of the park area except in such places or receptacles as may be provided and designated therefor.
B. 
No person shall throw, lay or deposit any glass, crockery, empty containers or any other sharp or broken or otherwise dangerous object or material or substance in or on any bathing area or any natural waters in the park.

No person shall kindle, build or maintain a fire or portable cooking device in the park except by expressed permission from the Town Board and in such designated places as may be provided, using charcoal only.
No store, stand, vending truck or machine or any commercial device or enterprise offering for sale, hire or lease any object or merchandise or service shall be maintained in the park except under special use permit.

No dogs shall be allowed near water or on public beaches at any time. Dogs are allowed at East Greenbush Dog Park and all dogs must be on a leash.

A. 
No person shall injure, deface, displace, remove, fill in, raze, destroy, disturb, or tamper with any part of the park, including, but not necessarily limited to, any building, fixture, equipment, trees, vegetation, soil, mineral, or any other property appurtenant thereto, whether personal or real, that is owned by the Town of East Greenbush.
B. 
No person shall pursue, disturb, hunt, trap, injure, wound, maim, or kill any bird, reptile, or animal, domestic or wild, within the boundaries of the park unless authorized to do so as a law enforcement officer or as the Town's duly appointed animal control officer operating in a lawful manner under the explicit direction of the Town Supervisor; except that noncommercial sport fishing is permitted as provided by law and as limited pursuant to § 60-4 hereof.
No person shall throw, drop or discharge into any waters of the park or any tributaries thereto any substance or any matter which may result in the pollution of said waters.
The Board may regulate the parking and control of motor vehicles within the park and may establish a fee for the parking of motor vehicles within the park.
Wherever provision is made herein for a "permit," it shall mean a permission or an authority granted by the Town Board by resolution and pursuant to application therefor; or a permit issued by the Town Clerk pursuant to authority vested in that office by law or by delegation from the Board.

No person shall carry, use, or have in his possession any explosive(s), firearm(s), air pistols or rifle(s), BB gun, bow and arrow(s), slingshot(s), or any other projectile-firing weapon(s) or dangerous implement(s) within the boundaries of the park unless authorized to do so as a law enforcement officer or as the Town's duly appointed animal control officer operating in a lawful manner under the explicit direction of the Town Supervisor.[1]

If any section, paragraph, clause or provision of this chapter shall be adjudged invalid, such adjudication shall apply only to the particular section, paragraph, clause or provision so adjudged, and all remaining provisions, rules or regulations contained in this chapter shall remain valid and in full force and effect.

Any violation of the provisions, rules or regulations contained in the foregoing chapter shall constitute a misdemeanor and, on conviction, a person so offending may be punished by a fine of $250 for the first offense and $500 for the second and all subsequent offenses; excepting that any violation of § 60-13 herein relating to the regulation and parking of motor vehicles shall constitute a traffic infraction and not a misdemeanor.
The Town Clerk of the Town of East Greenbush is hereby directed to publish the foregoing chapter of the Town of East Greenbush promulgated under § 220, Subdivision 4, of the Town Law establishing rules and regulations for the custody, control and operation of the Town Park known as "Hampton Lake" on the 27th day of April 1957 in the Troy Record, which is hereby designated for that purpose, and to post the same on the signboard maintained in the Town Clerk's office by the Town Clerk pursuant to Subdivision 6 of § 30 of the Town Law, and this chapter shall become effective 10 days after posting and publishing, to wit: May 7, 1957.
