This article shall be entitled and may be cited as an "Ordinance of the Town of East Greenbush, County of Rensselaer, State of New York, regulating the use of trucks, commercial vehicles, tractors and tractor-trailer combinations on certain streets and highways in said Town."
A. 
All trucks, commercial vehicles, tractors and tractor trailer combinations either weighing or having a gross weight in excess of five tons, other than omnibuses, shall be excluded from the following highways and streets in the Town of East Greenbush, County of Rensselaer, State of New York:

B. 
All garbage trucks must have a permit.

All trucks, commercial vehicles, tractors and tractor-trailer combinations, regardless of weight, other than omnibuses, shall be excluded from the following highways and streets in the Town of East Greenbush, County of Rensselaer, State of New York:

Notwithstanding any provision of this article, the Town Board of the Town of East Greenbush, County of Rensselaer, State of New York, may, by resolution, grant permits permitting the permittee to deliver or pick up merchandise, fuel oil or property by motor vehicle on any of the streets and highways mentioned in this article, despite the weight of the vehicle to be used, upon such terms and conditions as such Town Board deems reasonable and in the interests of said Town; provided, however, that no such permit shall be granted if the permittee has other access to the property to be served, which access he is not prohibited from using by lawful law, local law, ordinance, rule, regulation or order, and further, provided that no such permit shall be valid for more than one year, and further provided that no charge shall be made for any such permit. Notwithstanding any provision of this article, this article shall not apply to any motor vehicle used and operated by any of the following: the State of New York; the County of Rensselaer, State of New York; the Town of East Greenbush, County of Rensselaer, State of New York; any fire district, fire protection district, fire department or fire company; or any public utility.[1]

If any part or parts of this article or its application to any street or highway designated herein is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this article.

Penalties for violation of this article shall be in accordance with the appropriate provisions of the Vehicle and Traffic Law of the State of New York.
