This article shall be known as "Local Law No. 5 of 2002" and shall increase the term of office for the Town Clerk of the Town of East Greenbush from two years to four years pursuant to New York State Municipal Home Rule Law §§ 10 and 23.

It is the desire of the Town of East Greenbush to stabilize the position of Town Clerk by extending the term of office of such Town Clerk from two years to four years, to take effect at the term commencing January 1, 2004. In such manner, there will be more continuity in office as well as experience available from the position of Town Clerk for the Town of East Greenbush.
This article is brought pursuant to Municipal Home Rule Law §§ 10 and 23 and shall serve to extend the term of office of the Town Clerk for the Town of East Greenbush from a two-year term to a four-year term to take effect commencing January 1, 2004. Such legislation is subject to mandatory referendum and is brought procedurally pursuant to Municipal Home Rule Law §§ 10 and 23. Such mandatory referendum shall be conducted in November 2002 concurrent with those other elections for public office. A proposition in the following form shall be included on the ballot at such election, and the increased term of office shall not take effect unless such proposition is approved by a majority vote of the qualified voters voting thereon:
"Shall Local Law No. 5 of 2002, entitled 'A Local Law increasing the Term of Office of the Town Clerk of the Town of East Greenbush from Two to Four Years' be approved?" |
This article shall supersede in its application to the Town of East Greenbush Town Law § 24 with respect to the term of office of the elected Town Clerk.
