No person shall burn or allow or permit to be burned any brush, leaves, lumber, paper products, plastic, tires, chemicals, trash, garbage, refuse, wood or other related items in the Town of East Greenbush.

Nothing contained herein, however, shall prevent the operation of outdoor grills or fireplaces for the preparation of food.
The Town Board may authorize the Commissioner of Public Works or the Fire Districts to burn structures, lumber, brush or other items, provided that all permits required by the Health Department or the New York State Department of Environmental Conservation are obtained and complied with.

Every person convicted of violating any provision of this chapter shall be guilty of a violation punishable as follows: by a fine of $100 for the first instance and $250 for any subsequent violation. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct violation hereunder.
The enforcement of this chapter shall be made by members of the East Greenbush Police Department, but shall not restrict enforcement which would be conducted by any other police officer of the State of New York.
