For the purposes of this article, the following terms shall have the meanings respectively ascribed:
DOG PARKS
A fenced-in area within a City-owned property designated and approved for dog exercise where dogs are allowed off leash while under the supervision of their owner(s). Owners are subject to Article 7 of the Agriculture and Markets Law (Chapters 220 and 221, Laws of 1978) and all City of Troy municipal rules and regulations that govern dogs. Enforcement shall be set by § 124-23, dog park rules. Fencing shall meet the standards of dog park fencing throughout New York State, under the guidelines of the American Kennel Club.

PARK
Any municipal park or recreational facilities owned, operated or under control of the City.
PERMIT
A written authorization issued under the authority of the Commissioner of Parks and Recreation with the approval of the Mayor, permitting the performance of a specified event or contest in any of the parks or recreational facilities.
RESIDENT RECREATION ID
An identification card issued to City residents.
A. 
A Recreation Advisory Committee is hereby established.
B. 
The Committee shall consist of 19 members, which shall include participants and enthusiasts in major sporting fields, including but not limited to tennis, baseball, golf, soccer, track, boxing, swimming, football and basketball, to be appointed by the Mayor for a term of two years. The Chair shall be elected from among the membership, and the Commissioner of Recreation and the City Youth Coordinator are to be ex officio members, and a member from the Youth Advisory Board shall be appointed by the Chair of that Board as an ex officio member.
C. 
The powers and duties of the Committee shall be to:
(1) 
Examine the distribution and use of the present facilities within the City of Troy and, based on this data, make suggestions and recommendations to the City Council and Department of Recreation of means to more effectively utilize the present facilities and/or possible rehabilitation or construction of new facilities;
(2) 
Examine in general how the City of Troy can best meet the need of the sporting participants; and
(3) 
Seek to encourage active public participation in the various sports, including spectator participation.
D. 
The Committee shall submit a report to the Recreation Department and City Council every three months concerning recommendations as may be necessary to fulfill the purposes of this section.
A. 
All parks or park areas and recreation buildings and facilities shall be open during hours and on days posted by the Commissioner of Parks and Recreation with the approval of the City Mayor.
B. 
No person shall under any circumstances loiter or remain in any park or park area or park building between closing and opening time, as specified and posted by the Commissioner of Parks and Recreation pursuant to Subsection A of this section. A violation of this section shall constitute a violation and shall be punishable by a fine not exceeding $250 or by imprisonment not exceeding 15 days, or by both. The Commissioner of Parks and Recreation shall post signs in all the parks of the City, specifying the open and closed hours and giving warning of the penalties for such violation.
Any request for a permit for the use of any facilities of any park or park area, fields or buildings or part of any building therein shall be made to the Commissioner of Parks and Recreation or his/her designated agent; such request may be written or verbal.
The following uses and activities shall be and are hereby prohibited in a park or park area:
A. 
Injury to property. No person in a park or park area shall injure, deface, displace, remove, destroy or tamper with any gates, fences, seats, shelters or structures of any nature whatsoever, or any equipment or building or part thereof, or any sign, notice or inscription, or any growing thing, owned, operated or under control of the City.
B. 
Rubbish, debris. No person shall carry through, leave or throw, drop or discharge any rubbish or debris of any nature in any park or park area.
C. 
Spitting. No person in any park or park area or any building or structure therein owned or operated by or under the control of the City shall expectorate upon any portion thereof or in any structure, walk, stairway or floor.
D. 
Advertising. No person shall distribute or display any flag, banner, sign or any other matter for advertising purposes within any park or park area, nor attempt to attract attention for advertising purposes by the use of any musical instrument or any sound device within any such area, without the approval of the Commissioner of Parks and Recreation.
E. 
Soliciting. No person shall solicit for any purpose whatsoever.
F. 
Disorderly conduct. No person shall annoy persons or people or do any act tending to create a nuisance and breach of the peace.
G. 
Golf. The playing or practicing of golf, the driving or hitting of golf balls is prohibited, except at golf courses.
H. 
Bicycle riding. Bicycle riding is prohibited, except on proper paths and roadways.
I. 
Abusiveness, obscenity. No person shall use threatening, abusive, profane or obscene language or perform any obscene or indecent act.
J. 
Entry, exit. No person shall enter or leave any park or park area or building except by the established entranceways or exits.
K. 
Acts causing injury. No person shall do any voluntary act which will cause or contribute to the injury of any person, animal or property within any park or park area.
L. 
Disrobing. No person shall disrobe or assist, aid or abet any person to disrobe within the park or park area, except in designated places.
M. 
Camping. No person shall tent, camp or erect or maintain a tent shelter in any park or park area, except by permission from the Commissioner of Parks and Recreation.
N. 
Weapons, fireworks. No person shall bring in or have in his/her possession in any park or park area any firearms or concealed weapons or fireworks of any nature whatsoever.
O. 
Sales. The sale of any wares, merchandise, foods and beverages of any type or nature within all park grounds and buildings is prohibited except with the written permission of the Commissioner of Parks and Recreation.
P. 
Fires. No person shall kindle, build or maintain a fire in any park or park area, except at approved locations.
Q. 
Animals. No dogs or domesticated animals shall be allowed in the park except within or enroute to a designated dog park area designated by this Code.

R. 
No person shall smoke within the City’s sport fields, swimming pools, or playgrounds. For purposes of this section, to "smoke" means to burn a lighted cigar, cigarette, or pipe, or to use any other substances which contain tobacco. Violation of this section shall be an offense punishable by a fine of $50. Appropriate signage shall be posted designating tobacco-free zones; however, the presence or absence of signs shall not be a defense to a violation of this section.

During the season, specials may be offered to promote play. These include, but are not limited to, 2-for-1 calendar card specials and fall specials. Specials shall be designed by the Golf Course Manager and the Golf Course Superintendent, subject to the approval of the Commissioner of General Services. Tournament outings must have 24 or more paid participants. College students must provide a valid college student identity card to receive the student rate.

To prove residency, acceptable forms of identification include: driver's license, government-issued identification that includes an address, tax/utility bills, or a canceled rent check showing a Troy address. A driver's license showing a PO Box address will not be accepted as proof of City residence.

Pool hours of operation:

Fuel prices: diesel and ethanol-free marine gas. Fuel prices, per NYS OGS contract, fluctuate on a weekly/daily basis. Retail prices shall be set so as to be competitive with other marine fueling depots.

Tour vessels: All tour vessels: $500 per docking event.

Off-season docking rates, commercial vessels/barges (fall/winter season).

Per foot, up to seven days: $100.

Per foot for full season, October/November through March/April: $150. (This rate shall apply to any commercial vessel requesting out-of-season docking on any portion of the City seawall. The commercial vessel owner/operator shall also be required to enter into a license agreement and to provide the City with a certificate of liability insurance in the general aggregate amount of not less than $1,000,000, or as otherwise required at the time of docking, whichever is greater, and naming the City of Troy as an additional insured.)

A. 
The Commissioner of Parks and Recreation is hereby authorized to prepare and issue recreation resident identification cards, hereafter known as “recreation ID's,” to residents of the City who are actually domiciled within the corporate boundaries of the City.
B. 
A service charge of $3 may be made for the first-time issue for such recreation ID. A service charge of $2 may be made for the renewal of each recreation ID.
Under the supervision of the Commissioner of Public Safety and/or the Commissioner of Recreation, park rangers employed by the City of Troy are hereby authorized to issue appearance tickets to persons who are violating, in their presence, park rules and regulations as set forth in this chapter and to issue traffic summonses for violations of the provisions of Chapter 270, Vehicles and Traffic, of this Code, within the parks of the City of Troy.

The City of Troy hereby establishes a full-time administrative position in the Recreation Department, "Director of Recreation," who shall be the department head for the Recreation Department. This position shall be a nonrepresentative position.
