All abandoned, stolen or recovered property of every kind, except motor vehicles, which shall remain unclaimed with the police department for a period of one hundred twenty days without being claimed or reclaimed by the owners, whether known or not, may be sold at public auction or appropriated to the city’s use as provided in this article.

The chief of police shall give the city manager a list of all property subject to sale under this article together with the name and last known address of the owner thereof.

The city manager shall post or cause to be posted thirty days’ notice of the time and place of sale and a descriptive list of the property to be offered for sale at the entrance door to the city hall, and a copy thereof sent by regular mail, postage prepaid, to the last known address of the owner or owners of any such property.

Such property shall be offered for sale at public auction to the highest bidder for cash. Such property may be sold as individual items or assembled in lots at the discretion of the city manager; provided, however, that the head of any department of the city may request, in writing, that any items offered or to be offered for sale be assigned to his or her department. The city manager may, at his discretion, assign such item or items to such department or sell such item or items at public auction.

The city manager shall conduct such public auction and shall keep an accurate statement of each article sold and the price bid and paid therefor. All funds received on account of such auction shall be placed in the general fund of the city, to be thereafter disbursed as the city council shall order.

Any such property which remains unsold after being subject to two auctions may at the discretion of the city manager be ordered destroyed and disposed of in a suitable manner.

Any person violating any of the provisions of this article shall be deemed guilty of a separate offense for each day or portion thereof during which any violation of any of the provisions of this article is committed, continued or permitted, and each violation shall be punishable by a fine in accordance with the general penalty provision found in section 1.01.009 of this code.
