Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this division shall be fined in accordance with the general penalty provision found in section 1.01.009 of this code. Each day that a violation is permitted to exist shall constitute a separate offense.

It is unlawful for any person to dig up, mar, mutilate or deface any street, alley or other public right-of-way, or any part thereof.

Before any opening, excavation or cut by any public utility, contractor, repairman or other person is made in, on or under any street, alley or other public property of the city, a permit shall be obtained, showing the scope of work to be done, time, place, and plans for restoring the street, alley or public property to its original state at the time of beginning such construction, maintenance or repair. Fees for such permits shall be established by the city council and adopted by resolution.

Prior to the issuance of the required permit for such work as mentioned in section 3.12.063 of this division, the city shall require the public utility, contractor, repairman or other person to obtain a bond in the amount equal to the cost necessary to repair the opening, excavation or cut to comply with city construction standards and specifications. The bond shall be held by the city secretary until such time as the designated representative of the city deems the repairs to have been made in accordance with city construction standards and specifications. Upon approval by the designated representative of the city, the bond shall be released.
