“Garage sale,” as that term is used herein, is defined
as an offering for sale, exchange or barter to the general public
of merchandise in a garage or upon the patio, yard or in a building
used strictly as a residence within the corporate limits of the city.

(a)
Any person, firm or corporation that violates, disobeys, neglects or refuses to comply with or that resists the enforcement of any of the provisions of this article shall be fined in accordance with the general penalty provision found in section 1.01.009 of this code. Each day that a violation is permitted to exist shall constitute a separate offense and shall be punishable as such.
(b)
The
city may also bring suit for injunction against any person, firm or
corporation that shall violate or threaten to violate any of the provisions
of this article, in order to prevent a continued violation of such
threatened violation.

No person, firm or corporation owning or occupying property within the city that is strictly used for residential purposes and wishing to hold a garage sale as defined herein shall do so without first obtaining a permit from the city secretary and paying a permit fee as provided for in the fee schedule found in appendix A of this code.

(a)
No
person, firm or corporation owning or occupying property within the
city [that] is strictly used for residential purposes shall hold or
permit to be held on the same property more than two garage sales
in any calendar year.
(b)
It
is likewise unlawful for any person, firm or corporation holding or
permitting any one of the two authorized garage sales to permit the
same to continue for a duration in excess of three days consecutively.

No personal property owned by others and consigned to the person
offering such property to sell may be displayed, offered for sale
or sold except that up to five persons may combine their property
for sale at a single garage sale.

After a permit has been issued by the city secretary, one sign
shall be permitted to be posted, and such sign shall not exceed two
square feet in size. No off-premises signs shall be permitted along
city rights-of-way and on utility poles. Signs may be posted a maximum
of five days prior to the garage sale being held, and such sign shall
be removed within twenty-four hours following the last day of the
sale.

It shall be permitted that nonprofit organizations and fraternal
organizations shall be exempt from the permit fee as provided in this
article, and further they shall be exempt as to the number of sales
per year as provided in this article.
