A temporary building designed for the sale of snow cones and commercially prepackaged items customarily associated with this use. Snow cone stands shall not include food items that require heating or cooking.

Any person, firm or corporation who violates, disobeys, omits, neglects, refuses or fails to comply with or who resists the enforcement of any provision of this division shall be fined in accordance with the general penalty provision found in section 1.01.009 of this code for each offense. Each day that a violation is permitted to exist shall constitute a separate offense.

It is unlawful for any person, partnership, firm or corporation to operate a temporary snow cone stand within the city limits without having first obtained a temporary snow cone stand sales permit for such sales.

All applications for temporary snow cone stands as specified in this division must contain the following information:
(1) 
The name, address and telephone number of the applicant;
(2) 
The name, address and telephone number of the landowner and a written statement from the landowner showing that permission has been given to use the property as requested;
(3) 
The number of off-street parking spaces to be furnished for the site;
(4) 
The location of restroom facilities which are available on the same property or lot for customers and sales personnel or, in the alternative, if restrooms are not available on the site, written permission by the neighboring business whose facilities are to be used. The facilities shall be located on property immediately adjacent to the site and shall be within 300 feet travel distance of the snow cone stand. Property separated by a public street shall not be deemed as being adjacent;
(5) 
A showing that the proposed site of snow cone stand sales is properly zoned office, heavy commercial, commercial, central business district, industrial or institutional;
(6) 
A nonrefundable application fee in an amount as provided for in the fee schedule found in appendix A of this code.

The following requirements shall apply to the issuance of a temporary snow cone stand sales permit:
(1) 
Permits for snow cone stands shall not be issued prior to March 15th and shall expire on September 30th of each year;
(2) 
No structure shall be located within any street right-of-way nor shall they obstruct traffic visibility;
(3) 
Snow cone stands shall be placed on an improved surface and shall have improved parking;
(4) 
No permanent signs associated with the snow cone stand shall be allowed;
(5) 
All electrical connections shall comply with adopted codes;
(6) 
A separate electrical permit shall be obtained for all electrical work required to operate the business, and power shall not be released until all requirements of this division have been met.

A church, school, civic or other nonprofit entity who conducts a fund-raising event for a period of less than thirty consecutive days is exempt from the permit requirements provided no structure is located within the street right-of-way or obstructs traffic visibility.

(a) 
The temporary sale of snow cones shall be permitted for the period of April 1st to September 30th.
(b) 
Each snow cone stand shall be temporary and shall be removed in its entirety no later than October 21st of the year in which the permit was issued.
