This Part
1 shall be known and cited as the "Recreation and Park Ordinance."

As of the effective date of this Part
1, the existing Recreation and Park Board is dissolved, and any and all powers, authority or responsibilities assigned thereto by prior resolution or otherwise are rescinded.

The Supervisors hereby establish a Department to be known as the "Recreation and Park Department" (the "Department"). A five-member Recreation and Park Board (the "Board") is established, and the members of said Board (the "Board member(s)") shall be appointed by the Supervisors, at their sole discretion. All persons appointed to the Board shall serve their full terms, as set forth in §
16-104 below, unless voluntarily resigned or removed by the Supervisors for dereliction or neglect of duty, as determined by the Supervisors in their sole discretion.

1. Board members first appointed shall be appointed with staggered terms

2. Thereafter, Board members shall serve terms for five years, or until
their successors are appointed. Vacancies occurring other than by
expiration of term shall be for the unexpired term and shall be filled
in the same manner as original appointments.
3. Board members shall be residents of Jackson Township. Board members
shall serve without pay but may be reimbursed by the Township for
all reasonable and necessary expenses incurred in performing their
duties.

1. The Board shall elect its own Chairman and Secretary and create and
fill such other offices as it may determine. Officers shall serve
for a term of one year. The Board may propose bylaws, rules and regulations
for its procedure and operation of facilities, and they must be consistent
with the laws of the United States, the Commonwealth of Pennsylvania
and ordinances of Jackson Township. Any such by law, rule or regulation
shall be effective only upon approval by the Supervisors and shall
remain in effect unless suspended by vote of the Supervisors.
2. The Board may supervise, regulate, equip and maintain all Township-funded
recreation programs and facilities. The Board shall have no powers
other than those specifically delegated to it by the Supervisors,
as set forth herein.
3. The Board shall submit a report to the Supervisors within 45 days of the effective date of this Part
1, and annually thereafter on October 15, of recreational needs, objectives and activities, with particular reference to the effectiveness of the recreation program in view of the public expenditure involved and the public needs to be met. The report shall include data on usage of the park by Jackson Township residents.
4. The Board shall also submit a budget request to the Supervisors within 45 days of the effective date of this Part
1, and annually thereafter on October 15, which budget shall state with particularity the proposed expenditures for the following year.

1. Unless specifically delegated, all powers over recreation programs,
activities, and facilities are reserved to the Supervisors. Without
limiting the foregoing, the Supervisors reserve the following specific
powers:
A. To make and enter into contracts concerning Jackson Township's
recreation program or facilities.
B. To approve all recreation expenditures and make payment thereon.
C. To approve and adopt annually a budget for recreation and park purposes.
D. To suspend by laws, rules or regulations adopted by the Board, and
to overrule Board decisions.

The parcel of land heretofore acquired for recreation and park
purposes located on municipal property is hereby designated as "Jackson
Township Park."
