Pursuant to a directive from the New York State Department of
Environmental Conservation (NYSDEC), the Town of Tonawanda is required
to reduce the infiltration and inflow (I&I) of water into the
sewage system on a 4:1 (four gallons per day I&I to one gallon
per day peak sewage flow) ratio for each new sewer connection (greater
than 2,500 gallons per day) into the Town's POTW. In an effort to
develop a flexible program to suit the Town's wide ranging I&I
reduction efforts, the Town is requiring that applicants proposing
new sewer connections pay a one-time fee for I&I reduction. In
accordance with this concept, the Town is establishing a Sewer Remediation
Trust Fund into which applicants proposing new sewer connections will
pay a fee for which the Town will use on I&I reduction projects.
There is hereby established the Town of Tonawanda Sewer Remediation
Trust Fund.
Prior to establishing a new sewer connection to the Town sewer
system, new users shall commit to payment at a rate established in
the Fee Schedule for new projects.
Credit for remediation efforts shall be based on the Town of
Tonawanda Sewer Remediation Trust Fund Fee Schedule, which the Town
Board may amend by resolution. The schedule can be located on the
Town's website.
Payments into the Town of Tonawanda Sewer Remediation Trust
Fund shall be at a rate established in the Fee Schedule for new projects,
based on the Town's cost to remediate.
The Town Engineer shall administer the policies and procedures
relative to this trust fund.
