It shall be unlawful for any person without lawful authority to damage or cause injury to any street, alley, road, highway, sidewalk or other public way.

No person shall cut, remove or repair any part of any street surface in the city unless such person has applied for and received a permit from the city. Such application shall be accompanied by a permit fee as outlined in the fine and fee schedule found in appendix A of this code for building permits.

The applicant, before receiving a permit required under section 3.07.002, must present a bond guaranteeing satisfactory performance in an amount to be determined by the city manager and such bond must be signed by at least one corporate surety licensed to execute bonds in the state, approved by the city manager.

The actual work in cutting, removing and repairing street surfaces must be done pursuant to specifications prescribed by the city.

(a) 
Private property owners are responsible for all maintenance and upkeep of sidewalks and pedestrian rights-of-way located on their property. Maintenance and upkeep includes, but is not limited to: mowing, edging, clearing of debris, and keeping the sidewalk or pedestrian right-of-way free of all nuisances as defined by state law or the city’s Code of Ordinances.
(b) 
The city will repair or replace deteriorated or damaged sidewalks when funds become available.
