Bicycle.
A vehicle for one person, consisting of two large, spoked, tandem wheels, a steering handle and a saddle or seat on which the rider sits to work two pedals which, by making a chain engage in a series of cogs, drive the back wheel.
Custodian.
A natural or adoptive parent or court-appointed guardian or conservator or any other person responsible for the conduct or behavior of a child.
Helmet.
Properly fitted protective headgear that is not structurally damaged and that conforms to the standards of the American National Standards Institute, the American Society for Testing and Materials, the Snell Memorial Foundation or any federal agency having regulatory jurisdiction over bicycle helmets, as applicable, at the time of the manufacture of the helmet.
Motor-assisted scooter.
A self-propelled device with:
(1) 
At least two wheels in contact with the ground during operation;
(2) 
A braking system capable of stopping the device under typical operating conditions;
(3) 
A gas or electric motor not exceeding 40 cubic centimeters;
(4) 
A deck designed to allow a person to stand or sit while operating the device; and
(5) 
The ability to be propelled by human power alone.

(a) 
All ordinances of the city and all laws of the state relating to traffic and the movement of vehicles on the streets and highways of the state and the city shall apply to and govern the movement of bicycles on such streets and highways in the city.
(b) 
It shall be unlawful for the custodian of any child under the age of seventeen (17) years to permit such child to ride a bicycle on the public streets or alleys of the city, unless such child has learned the laws and regulations pertaining to vehicular traffic in effect in the city to such a degree of proficiency as to be able to comply therewith. Proof that such a child has violated a traffic law or ordinance shall be prima facie proof that such child does not know the laws and regulations pertaining to vehicular traffic to such a degree of proficiency as to be able to comply therewith.
(c) 
It shall be unlawful for person to ride any bicycle, skateboard, roller skates, or similar means of transportation on any of the sidewalks within the city.
(d) 
It shall be unlawful for a person to ride a bicycle on any public street or alley within the limits of the city, before sunrise or after sunset, unless such bicycle is equipped with a light on the front and a red light or red reflector on the rear thereof.

(a) 
It shall be unlawful for a person to operate a motor-assisted scooter on a sidewalk within the city.
(b) 
It shall be unlawful for a person to operate a motor-assisted scooter on a park owned by the city except on any path or trail set aside for the exclusive operation of bicycles in such park.
(c) 
It shall be unlawful for a person to operate a motor-assisted road, or highway in the city that has an improved surface that is greater than seventeen (17) feet in width.
(d) 
It shall be unlawful for a custodian to allow or permit a child under the age of ten (10) to operate or ride a motor-assisted scooter on a public way or public property unless the child is wearing a helmet.

Any violation of this article is a class C misdemeanor punishable by a fine in accordance with the general penalty provision found in section 1.01.009 of this code.
