The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Emergency situation.
For the purposes of this article, one in which there is imminent danger of collision with property, persons or animals.
Engine brake.
An auxiliary or compression engine brake (also known as “jake brake”) installed on a motor vehicle, truck-tractor or truck which produces any noise in addition to the normal operating engine noise.

It shall be unlawful for any driver of a motor vehicle, truck or truck-tractor to activate or use the unit’s engine brake within the city limits except in an emergency situation. This provision is not intended to prohibit the passage of vehicles equipped with engine brakes or “jake brakes” in posted areas but rather to prohibit the use of such equipment in posted areas.

Any person violating any provision of this article shall be guilty of a class C misdemeanor and, upon conviction, shall be fined in accordance with section 1.01.009 of this code. Each day that a provision of this article is violated shall constitute a separate offense.
