(a)
Established.
The monthly rates and charges for the sales made of services rendered by the wastewater system of the city are established, levied, fixed and prescribed as set forth in the following subsections.

Small commercial service rate schedule.
(1)
Availability.
This schedule is for nonresidential consumers that have a single water line to their location that is no larger than 3/4-inch diameter; a single sewer line, no larger than 4-inch diameter; no more than 10 plumbing fixtures; and whose function, processes or product does not utilize or require water.
(3)
Any customer receiving city water service and connected to the city sewer system must pay the net monthly base rate shown above.
(d)
Medium commercial rate schedule.
(1)
Availability.
This schedule is for nonresidential customers that have a single water line to their location that is no larger than 3/4-inch diameter; a single sewer line, no larger than 4-inch diameter; no more than 10 plumbing fixtures; and whose function, process or product utilizes or requires water such as a food processing facility, restaurant, bakery, deli, or other nonresidential food processing.

Any customer receiving city water service and connected to the city sewer system must pay the net monthly base rate shown above.
(e)
Large commercial rate schedule.
(1)
Availability.
This schedule applies to nonresidential customers at commercial or general service locations with a wastewater service line at least 6 inches in diameter and smaller than 8 inches in diameter.
(f)
Extra large commercial rate schedule.
(1)
Availability.
This schedule applies to nonresidential customers at commercial or general service locations with a wastewater service line 8 inches in diameter or larger.
(g)
Multifamily rate schedule.
(1)
Availability.
This schedule applies to apartment complexes, condominiums, cooperatives or any other location that provides residential housing with 2 or more individual dwelling units per water meter and/or provides offices or common areas for residents.
(h)
Surcharges for wastes of abnormal strength–Cost for testing.
(1)
The net monthly base rates for customers discharging wastes into the city sanitary sewer system shall apply provided the biochemical oxygen demand (BOD) in the wastewater does not exceed the concentration of 350 mg/l or the total suspended solids (TSS) in the wastewater does not exceed the concentration of 375 mg/l (parts per million). Anything more than that is unacceptable.

When the BOD exceeds 350 mg/l at the point of entering the city’s system or the TSS exceed 375 mg/l (parts per million) at the point entering the city’s system, a surcharge shall be applied and added to the net monthly base rate by multiplying the normal base rate by the factor obtained from dividing the actual measured BOD by 375 and also by the factor obtained from dividing the actual measured TSS by 350, each such factor to be applied individually and only when greater than one. The surcharge will be made for each factor that exceeds one.

Locations suspected of dispensing wastewater with an unacceptable level of BOD and/or TSS will be tested by an independent laboratory, selected by the city. The sample shall be a six-part composite sample taken by a city-authorized collector. The time of selection of the sample shall be at the sole discretion of the city and is intended to be at random intervals.

(A)
When tests show that a surcharge should be applied, continued or increased over the base rates, the owner shall be billed an additional $30.00 per month for the BOD and/or TSS laboratory test fees. When a surcharge is in effect the test will be conducted regularly at least once each month.
(B)
Should the customer desire a more frequent testing schedule for the purpose of averaging, the customer will be required to pay an additional $100.00 for each additional combination of tests conducted.
(C)
When the regular monthly tests made by the city or the tests requested by the customer reveal that the level of BOD and/or TSS is at an acceptable level for three (3) consecutive months then the surcharge shall no longer be applicable.
(5)
No sewage having a greater BOD or TSS of 400 mg/l shall be allowed in the city sanitary sewer system. Any sewage having a BOD or TSS of 400 mg/l or more must be pretreated before it can be emptied into the system.
(i)
Review of rates and surcharges.
(1)
Starting on October 1, 2023, the customer charge rate will be increased at a rate of $1.00 per year for a five-year term. The initial five-year term of the customer charge rate will automatically be extended for successive additional five-year terms or of any successive five (5) terms unless the governing body changes and/or discontinues rate schedule.
(2)
Starting on October 1, 2023, subsections (b), (c), (d), (e), (f), and (g) rate schedules will increase at the most recent percentage of the Consumer Price Index-Urban (CPI-U) but not less than a CPI-U rate of 0.75% and not to exceed a multiplier of 3.75% of CPI-U rate ending July (unadjusted 12 mos.) preceding September 30th for five-year term. The initial five-year term of the CPI-U rate schedule will automatically be extended for successive additional five-year terms or of any successive five (5) terms unless the governing body changes and/or discontinues rate schedule.
