It shall be unlawful for any person to allow cattle, horses,
mules, jacks, jennies, sheep, hogs, goats or other bovine, equine,
ovine or porcine animals to run at large within the city. Such conduct
is hereby prohibited and herein declared to be a public nuisance;
and anyone owning, controlling or having responsibility for the control
of any of the above named animals who knowingly permits such animals
to run at large within the city shall be guilty of a misdemeanor.

It shall be unlawful for any person to permit any chickens or
other domestic fowl belonging to him to run at large on the premises
of any other person with the city.

It shall hereby be unlawful for an individual to keep cattle,
horses, mules, jacks, jennies, sheep and goats in any enclosure less
then two (2) acres in area within the city. Additionally, it shall
be unlawful to contain the aforementioned animals in such a manner
or in such condition as to cause a danger to the public health, noxious
odors, or precipitate the spread of germs capable of producing disease.
A violation of any part of this section is hereby prohibited and declared
to be a nuisance.

It shall be unlawful for any person to keep or harbor swine
upon any lot or other tract of land within this city.

Any person who shall harbor or keep on his premises or in or
about his premises or premises under his control, any animal which
by loud or unusual barking, howling or other loud or unreasonable
noise, shall cause the peace and quiet of the neighborhood or occupants
of adjacent premises to be disturbed, shall be guilty of a misdemeanor.

It shall be unlawful for any person to own or maintain an animal
in such a manner as to constitute a public nuisance. The following
acts shall constitute a public nuisance:
(1) Failure to enclose an animal is defined in Article
2.100;
(2) Property
damage caused by an animal;
(3) Maintain
an animal in an unsanitary environment;
(4) Permit
an animal to bark, whine, howl, crow, cackle, or make any other noise
which causes annoyance or interference with another's reasonable use
and enjoyment of his premises;
(5) Herding
of animals along or upon any public right-of-way, except by officers,
agents, or employees of the federal, state or local government or
agency thereof, if such herding is done in the performance of official
duties;
(6) The harboring
or maintaining of more than three (3) dogs over six (6) months of
age in an enclosure, unless the enclosure contains at lease two thousand,
five hundred (2,500) square feet of space for each dog so enclosed;
(7) The harboring
or maintaining of any dog in any enclosure unless said enclosure is
kept clean, sanitary and free of offensive odors and the excrement
from such dog is cleaned up and disposed of or buried at least once
every twenty-four (24) hours;
(8) The harboring
or maintaining of more than six (6) adult chickens in a residential
lot of less than half of one (1) acre;
(9) The harboring
or maintaining of more than ten (10) adult chickens in a residential
lot of more than half of one (1) acre; and
(10) The
harboring or maintaining of more than one (1) rooster in a residential
area.

It shall be unlawful for any person to allow any animal to soil,
defile or defecate on private or public property, other than property
belonging to the animal's owner or individual in control of the animal.
The defecation shall not be considered unlawful if the owner or individual
in control of the animal promptly removes the excrement. For the purposes
of this article, public property shall include but not be limited
to parks, cemeteries, streets and alleys.
