It is the intent of the Borough Council of the Borough of Jonestown, by enacting this ordinance, to provide minimum standards for the protection of life, limb, health, property, and the environment, and for the safety and welfare of the consumer, general public, and owners and occupants of one- and two-family dwellings and one-family townhouses not more than three stories in height, by regulating their fabrication, erection, construction, enlargement, alteration, repair, location, and use, as well as for their appurtenances and accessory structures.

The Borough Council of the Borough of Jonestown hereby adopts the CABO One and Two Family Dwelling Code, 1995 Edition (hereinafter the "Code"), including Chapters 1 through 47, and Appendices A through F, which Code is incorporated herein by this reference hereto as if fully set out at length herein. From the date on which this ordinance takes effect, the provisions of the Code shall be controlling in the fabrication, erection, construction, enlargement, alteration, repair, location, and use of detached one-and two-family dwellings and one-family townhouses not more than three stories in height, their appurtenances and accessory structures within the Borough of Jonestown. Three copies of the Code have been and are now filed in the office of the Jonestown Borough Secretary/Treasurer, and copies are also filed in the office of the Lebanon County Planning Department.

The CABO One and Two Family Dwelling Code is hereby amended, as follows:
A. 
Section A600, Special Requirements for Foundation Systems, is specifically adopted.
B. 
Section A101, Scope, is amended to include manufactured homes used as a single-dwelling unit installed on rental lots and on privately owned (nonrental) lots.
C. 
The provisions for foundation systems and building service equipment connections necessary to provide for the installation of new manufactured homes on rental lots and on privately owned (nonrental lots) and existing manufactured houses to which additions, alterations, or repairs are made, as contained in Appendix A of the Code are specifically adopted. (See Note, Section 114.1 of the Code.)
D. 
Section 106.4, Penalty, is amended to read:
106.4 Penalty: Any person, firm, or corporation violating any provisions of this Code shall, upon conviction thereof, be sentenced to pay a fine not exceeding $1,000 and costs of prosecution, which shall include any attorney's fees incurred by the Borough of Jonestown in such prosecution, or, in default of payment, to imprisonment for a term not to exceed 30 days. Each day a violation of this Code continues shall constitute a separate offense.

In all matters that are regulated by the laws of the Commonwealth of Pennsylvania or by regulations of departments or agencies of the commonwealth promulgated by authority of law, such laws or regulations, as the case may be, shall control where the requirements thereof are the same as or more limiting than the provisions of this ordinance. The Code shall control in all cases where the state requirements are not as strict as those contained in this ordinance.

Fees and charges for permits for work regulated by the Code, for inspections related to that work, and for the examination of plans related to that work may be fixed by the Borough Council of the Borough of Jonestown from time to time by resolution. Further, the Borough Council of the Borough of Jonestown may, by resolution, delegate to an appropriate agency the administering and enforcement of the Code, including the setting of fees and charges for permits for work regulated by the Code.

All ordinances or parts of ordinances which are inconsistent herewith are hereby repealed.

If any sentence, clause, section, or part of this ordinance is for any reason found to be unconstitutional, illegal, or invalid, such unconstitutionality, illegality, or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections, or parts of this ordinance. It is hereby declared as the intent of the Borough Council of the Borough of Jonestown that this ordinance would have been adopted had such unconstitutional, illegal, or invalid sentence, clause, section, or part thereof not been included herein.
