No person, firm, partnership or corporation shall set or maintain any fire at any time upon any of the streets, sidewalks, alleys or public grounds in the Borough of Jonestown.
Fires shall be confined within a non-combustible container covered with a noncombustible mesh screen having 1/2 inch or smaller mesh. Such a container shall be located at least 25 feet from any building, automobile, garbage or waste container, or any other combustible substance.
The only materials that are allowed to be burned are paper, cardboard and clean, untreated wood. It is not permitted to burn wood that is treated with chemicals.
Fires for cooking and recreational/ceremonial purposes can be started anytime on private property so long as it meets the requirements of Paragraphs A and C.
No concrete, stone, brick or similarly constructed enclosures can be used for burning unless such enclosure has an inside enclosed area of 24 square feet or less, has a height of four feet or less, and is covered with a non-combustible screen as is set forth in Paragraph B above.
It shall be unlawful for any person, firm, partnership or corporation either directly or indirectly to kindle or maintain a fire when weather and/or atmospheric conditions, such as wind or other physical conditions, make such fires hazardous to human life and/or property.
On those properties that are situated in a district zoned R-o-residential Outlying or M-Light Manufacturing District, where it is impossible or impractical to confine a fire to a container, outdoor fires will be permitted if they are confined to an area no less than 100 feet from any building and no less than 20 feet from any adjoining property; provided, that no light weight material such as paper which can be raised into the air by wind or generated by heat and set adrift shall be burned in such a fire. Every such open fire shall be supervised from the time of incineration until the time of extinguishment to provide maximum protection to life and property.
Nothing in this section shall be construed to prohibit the use of family size outdoor barbecue equipment for household cooking purposes when any flame used is properly confined, supervised and extinguished.

The Mayor is hereby empowered and authorized to prepare such regulations in writing as may be necessary to implement the provisions of this Part consistent with the letter and purpose thereof, subject to review and approval by the Jonestown Borough Council.

Any person, firm or corporation who shall violate any provision of this Part 1 shall, upon conviction thereof, be sentenced to pay a fine of not more than $300; and/or to imprisonment for a term not to exceed 90 days. Every day that a violation of this Part 1 continues shall constitute a separate offense.
