This Part 1 shall be known and may be cited as "Jonestown Borough Trailer Ordinance".

Unless otherwise expressly stated, the following words and phrases shall be construed throughout this Part to have the meanings herein indicated:
The permit granted to a person who establishes and/or operates a trailer park.
Includes individuals, partnerships, corporation, owners, lessees, licensees and agents of each of them.
A unit of local, adequately drained ground of definite size, clearly indicated by corner markers, for the placing of one trailer in a trailer park.
Any site, lot, field, or tract of ground upon which three or more mobile homes are placed, and shall include any building, structure, tent, vehicle, or enclosure used or intended for use as a part of the equipment of such park. "Trailer Park" shall not include automobile or trailer sales lots on which unoccupied trailers are parked for purposes of inspection and sale.
Any vehicle or structure so designed and constructed in a manner as will permit occupancy thereof as sleeping quarters for one or more persons, or the conduct of any business or profession, occupation or trade, and so designed that it is or may be mounted on wheels and used as a conveyance on highways or city streets, propelled or drawn by its own or other motive power (regardless of whether wheels, rollers, or skids are attached or unattached), excepting a device used exclusively upon stationary rails or tracks.

No person shall engage in a trailer park business or maintain a trailer park business without first having obtained a license from the Borough Council for which license a fee as set forth in § 106 hereof shall be paid to the Borough for the use of the Borough. The license shall be issued for the twelve-month period beginning January 1, 1966, and ending December 31, 1966, and each license must be renewed annually before the first day of January of each succeeding year.

The license provided for in this ordinance shall be issued by the Council only after written application shall have been made therefor to the Secretary of the Council or other agent, by the person desiring such license. Such application shall state the name of the person to whom such license is to be issued, and the exact location of the premises on which such business is to be conducted or such trailer park maintained. Such license, if issued, shall be posted conspicuously upon the premises. The written application for such license shall be upon a form supplied by the Secretary and shall be accompanied by a plot plan or sketch, as set forth in § 110, of the premises to be licensed.

Upon receipt of an application by the Secretary of the Council, the Council shall, upon the recommendation of the Jonestown Borough Planning Commission, issue a license or shall refuse to issue a license to the person applying therefor after an investigation of the application and taking into consideration the suitability of the property proposed to be licensed; the character of the properties located nearby; the effect of the proposed use upon the Borough, both economic and aesthetic; and restriction upon property uses as set forth in other applicable Borough ordinances. In the event the Council shall issue a license, it may impose in the license and upon the licensee such terms and conditions, in addition to the regulations herein contained, as may be deemed necessary to carry out the spirit and intent of this Part 1.

The license fee shall be paid immediately upon the issuance or renewal of a license. The amount of the license fee shall be calculated in accordance with the following schedule as determined by the number of lots to be used by the person to whom the license is issued:

No person licensed under this Part 1 shall, by virtue of one license, keep more than one place of business or maintain or operate more than one trailer park within the Borough, nor shall any person engage in or operate a trailer park in any place other than the place designated in his license.

No license issued by the Council shall be transferable by the holder of such license to any other person unless such transfer is authorized by the Council. Any person desiring to transfer his license shall notify the Council, in writing, which notification shall be accompanied by an application for a license by the proposed transferee as described in § 104 of this Part 1.

In the event the Council shall approve the transfer of a license, the transferee shall immediately pay to the Borough a transfer fee of $10.

Every person licensed under this Part 1 shall constantly maintain the licensed premises in accordance with the provisions of this section and any subsequent regulations adopted or imposed by the Council.

Plot plan or sketch of trailer park shall include:
A.
The extent and area to be used for park purposes.
B.
Driveways at entrances and exits, roadways and walkways.
C.
Location and number of proposed sanitary conveniences, including proposed toilets, washrooms, laundries, laundry drying space and utility rooms.
D.
Location of sites for trailer coaches.
E.
Method and plan of sewage disposal.
F.
Method and plan of garbage and trash removal.
G.
Plan of water supply.
H.
Plan of electric lighting.
I.
Children's play area.

It shall be illegal to operate or conduct any trailer park or camp in Jonestown Borough for the purpose of housing residential trailers, without first obtaining a written statement of consent from all abutting property owners to the proposed trailer park or camp site.

Every trailer park shall be located on a well-drained area, and the premises shall be properly graded so as to prevent the accumulation of storm or other waters.
4.
Trailer parks shall have an entrance and exit well marked and easily controlled and supervised.

From and after the passage of this Part 1, trailer parks shall have surfaced roads in conformance with Borough specifications which shall be not less than 10 feet wide for one-way traffic, and 18 feet for two-way traffic.

From and after the passage of this Part 1, trailer parks shall have roads easily accessible to all trailers and shall be adequately lighted. The walkways to the various buildings shall be adequately surfaced and lighted.
7.
From and after the passage of this Part 1, a trailer park shall provide lots for each trailer of an area of not less than 2,250 square feet.
8.
From and after the passage of this Part 1, the minimum width of a trailer lot shall be 30 feet.
9.
From and after the passage of this Part 1, the minimum depth of a trailer lot shall be 75 feet.

Separate provision shall be made for the parking of cars at the rate of one off-street parking space for each trailer lot in the park.

Each trailer lot shall be located at least 10 feet from any permanent building, and at least 10 feet from the property line, and shall observe a minimum set-back distance of 30 feet from the right of way lines to all public streets or roads.

Adequate space must be provided for (a) clothes drying adjoining laundry facilities and (b) play space for children. A minimum of 3,000 square feet of play space shall be provided for mobile home parks of 10 or less trailer lots. An additional 200 square feet of play space shall be provided for each trailer lot in trailer parks containing more than 10 trailer lots.
13.
Drinking water, flush toilets, washing and bathing facilities shall be provided in accordance with state and local requirements and regulations.
14.
Laundry facilities shall be provided in the ratio of one double tub and ironing board for every 15 or less trailer lots. Where washing machines are available, laundry tubs shall be provided in the ratio of one double tub for each 20 or less trailer lots.

Waste from showers, toilets and laundries shall be disposed into a public sewer system or into a private sewer and disposal plant or septic tank system and in any case the method of disposal shall be one meeting the state and local health requirements.
16.
All kitchen sinks, wash basins or lavatories, bath or shower tubs in any trailer located in any trailer park shall empty into a disposal system which shall meet the state and local health requirements.
17.
Toilets and water closets in trailers shall be connected with a public sewer system or into a private sewer and disposal plant or septic tank system and in any case the method of disposal shall be one meeting the state and local health requirements. In case a septic tank system is used, additional open land area of not less than 1,000 square feet shall be provided for each mobile home coach lot in the trailer park for the installation of the septic tank and field drain tile.
18.
Each trailer shall be connected with a separate water supply system of pure drinking water for drinking and domestic purposes.
19.
Each trailer shall be provided with a separate electrical outlet or connection which outlet or connection shall be one approved by the Board of Fire Underwriters.
20.
Fly-tight metal depositories with tight fitting covers shall be conveniently located for the collection of rubbish and debris.
21.
In addition to the regulations herein prescribed, all trailer parks shall conform to the requirements as set forth in Chapter 4, Article 415 of the Public Health Regulations, Department of Health, Commonwealth of Pennsylvania.
22.
In trailer parks not meeting the requirements as set forth in this Part 1, a trailer shall not be replaced by another or the same trailer after it has been moved.
23.
The Borough of Jonestown shall cause all premises for which permits of any kind under this Part 1 have been issued to be inspected at all reasonable times and at such frequent intervals as may be required for the proper enforcement of this Part 1 and the safeguarding of the health and safety of the public. Interference with the duties of the duly authorized persons making such inspections shall constitute a violation of this Part 1.

From and after the passage of this Part 1, no individual trailer, existing prior to the passage of this Part 1, shall be moved to another location in Jonestown Borough except in strict conformity to the provisions of this Part 1, and no individual trailer shall be replaced by another trailer, except one by the same owner.

It shall be unlawful for the owner, tenant or legal custodian of any lot or piece of ground in Jonestown Borough to keep or permit to be kept any trailer upon any lot or piece of ground owned or leased by him or over which he has legal custody, other than in a trailer park authorized by Jonestown Borough in strict conformance with this Part 1.

Emergency or temporary stopping or parking is permitted on any street, alley, or highway for not longer than six hours, subject to any other and further prohibitions, regulations or limitations imposed by the traffic and parking regulations or ordinances for that street, alley, or highway.
3.
No person shall park or occupy any trailer on the premises of any occupied dwelling or on any lot which is not a part of the premises of any occupied dwelling either or which is situated outside an approved trailer park; except, the parking of only one unoccupied trailer in an accessory private garage building, or in a rear yard in any district, is permitted providing no living quarters shall be maintained or any business practices maintained in said trailer while such trailer is so parked or stored.

Any person who shall violate any of the provisions of this Part 1 shall, upon conviction thereof, in a summary proceeding, be sentenced to pay a fine of not more than $100, and the costs of prosecution; provided that each additional 30 days' violation of any of the provisions of this Part 1 shall constitute a separate offense; provided, further, that upon conviction of any violation of the regulations set forth in this Part 1, any license previously issued shall be revoked until the licensee complies with the provisions of this Part 1.

In addition to or in lieu of the remedies provided in § 113 above, any continued violations of this Part 1, which shall constitute a nuisance in fact or which shall, in the opinion of the Council, constitute a nuisance, may be abated by proceeding against the violator in a court of equity for injunctive relief.
