(a) No Thru
Truck Routes Established.
It shall be unlawful for any
person, firm, or corporation to operate upon the following named public
streets, highways or alleys within the corporate limits of the City
of Hillsboro, Texas, any commercial motor vehicle, truck, truck tractor,
trailer, or semi-trailer:
(1) Old
Brandon Road (FM Road 286) between the 700 Block of East Franklin
Street and Interstate 35.
(2) East
Franklin Street between Waco Street and Interstate 35.
(3) East
Elm Street between Waco Street and Interstate 35.
(4) Matthew
Street between South Church Sheet and Ivy Street.
(5) Mark
Street between South Church Street and Ivy Street.
(6) Alexander
Street from Ivy Street to FM Road 3267.
(7) Outlet
Drive from the North Line of Hillview Drive, two hundred forty feet
(240) north to end of the cul-de-sac.
(b) Defense.
It shall be a complete defense to prosecution under subsection
(a) that the driver of any such truck had departed from a route for the purpose of going directly to or from any residential, commercial or industrial establishment within the city for the purpose of delivering or picking up material thereat and had in their immediate possession any document defined as a proof of route use necessity.
(c) Marking
of Routes.
The city traffic engineer shall mark the routes
established herein by the erection of "No Thru Trucks" signs.
(d) Penalty
for Violation.
Any person who shall violate any provision
of this article shall be deemed guilt of a misdemeanor, and each such
person shall be deemed guilty of a separate offense for each day or
portion thereof during which any violation of any provision of this
article is committed, continued, or permitted, and each violation
shall be punishable by a fine in accordance with the general penalty
provision found in Section 1.109 of this code.
