The subdivider shall pay to the Village Treasurer all fees as
hereinafter required and at the times specified before being entitled
to record the plat or certified survey map concerned.

(a) The subdivider shall pay a fee as set forth in the Village Fee Schedule
to the Village Treasurer at the time of first application for approval
of any preliminary plat, final plat, condominium plat, or certified
survey map to assist in defraying the cost of administration and review.
(b) A reapplication fee as set forth in the Village Fee Schedule shall
be paid to the Village Treasurer at the time of reapplication for
approval of any preliminary plat, final plat, condominium plat, or
certified survey map that has previously been reviewed.

(a) The subdivider shall pay a fee equal to the cost to the Village for
such review as the Public Works Director deems necessary to assure
that the plans of the required improvements are in compliance with
specifications and ordinances of the Village or any other governmental
entity. Alternatively, the Public Works Director may pay and invoice
any third-party review fees directly to the Subdivider.
(b) The fee may be recomputed, upon demand of the subdivider or Public
Works Director, after completion of improvement construction in accordance
with the actual cost of such improvements and the difference, if any,
shall be paid by or remitted to the subdivider. Evidence of cost shall
be in such detail and form as required by the Public Works Director.

The subdivider shall pay a fee equal to the actual cost to the
Village for such inspection as the Public Works Director deems necessary
to assure that the construction of the required improvements is in
compliance with the plans, specifications, and ordinances of the Village
or any other governmental authority. Alternatively, the Public Works
Director may pay and invoice any third-party review fees directly
to the subdivider.

(a) If required by the Plan Commission under §
74-7.11,
a fee for the acquisition or improvement of public park sites, which include but are not limited to public parks, playgrounds, boat access sites, trail corridors, parkways, and open space sites, to serve the future inhabitants of the proposed land division or condominium shall be paid to the Village Treasurer at the time of first application for building permit for structures constructed on said land division or condominium in the amount set forth in the Village Fee Schedule. Such fees shall be established in accordance with § 236.45(6) of the Wisconsin Statutes.
(b) Public park site fees shall be placed in a nolapsing separate Service
District Fund by the Village Treasurer to be used only for the acquisition
or improvement of playground, park, parkway, or other open space site
that will serve the proposed land division or condominium. Said fund
shall be established on the basis of the service area of existing
or proposed park or open space sites.

(a) The subdivider shall pay a fee equal to the actual cost to the Village
for all engineering work incurred by the Village in connection with
the plat or certified survey map.
(b) Engineering work shall include the preparation of construction plans
and standard specifications. The Public Works Director may permit
the subdivider to furnish all, some, or part of the required construction
plans and specifications, in which case no engineering fees shall
be levied for such plans and specifications.

The subdivider shall pay a fee equal to the cost of any special
legal, planning or fiscal work that may be undertaken by the Village
in connection with the proposed land division or condominium plat.
Legal work shall include the review, negotiation, and drafting of
contracts between the Village and the subdivider and the review of
land division-related documents by the Village Attorney. These fees
may also include the cost of obtaining independent professional opinions
of, but not limited to, attorneys, engineers, planners, and landscape
architects requested by the Plan Commission or staff in connection
with the review of the land division or condominium plat being considered.

The subdivider shall have the right to challenge the amount of any fees levied under §§
74-10.3,
74-10.4,
74-10.6, and
74-10.7 of this Ordinance by an appeal to the Village Board. Upon receipt of such an appeal, the Village Board, upon due notice, shall hold a public hearing at which the subdivider and the Village officials concerned can present their case. Based upon review of relevant records and the testimony presented at the public hearing, the Village Board shall make a determination with respect to the fairness of the amount of the fees challenged and shall make a determination to decrease, affirm, or increase the fees concerned.
