There shall be established and maintained a court, designated
as a Municipal Court for the trial of misdemeanor offenses, with all
such powers and duties as are now, or may hereafter be prescribed
by laws of the State of Texas relative to municipal courts.
The Judge of said court shall be appointed by the Mayor with
the concurrence of the Council and shall serve at the discretion of
the Council. The Judge shall be an attorney licensed to practice in
the State of Texas and shall receive such salary as may be fixed by
the Council.
There shall be a clerk of said court appointed by the Town Administrator.
A. The
clerk of said court and deputies shall have the power to administer
oaths and affidavits, make certificates, affix the seal of said court
thereto, and generally do and perform any and all acts usual and necessary
performed by clerks and deputies of courts. The Council shall require
the Court Clerk before entering upon the duties of the office, to
execute a good and sufficient surety company bond, in such amount
as the Council may demand, payable to the Town and conditioned for
the faithful performance of the duties of the office, the premium
of such bond to be paid by the Town.
The Associate Judge(s) of said court shall be appointed by the
Mayor with the concurrence of the Council and shall serve at the discretion
of the Council. An Associate Judge shall be an attorney licensed to
practice in the State of Texas, shall have the same powers and duties
as the Judge of the Municipal Court, but shall not receive a salary
for the time and services the Associate Judge provides the Town. Rather,
the Mayor with the concurrence of the Council will determine and set
a reasonable fee to compensate an Associate Judge for the time and
services the Associate Judge provides the Town.
All costs and fines imposed by the Municipal Court shall be
paid into the Town Treasury for the use and benefit of the Town.
