"Public Parks," for the purposes of this Part 1 shall be all parks or recreational grounds owned by the Township of Jackson, County of Lebanon, or any other recreational ground operated by charitable organization for the use of the public without charge.

1. 
The following acts shall be prohibited and subject to prosecution under § 16-105 of this Part 1.
A. 
There shall be no overnight camping in any public park.
B. 
There shall be no igniting, building or conducting of any open fires.
C. 
There shall be no possession or consuming of alcoholic beverages as such beverages are defined in the liquor and alcoholic beverage laws of the Commonwealth of Pennsylvania. Alcoholic beverages may be permitted by the Supervisors in the public parks of the Township for special events upon receipt of an appropriate application in accordance with § 16-102, Subsection 2.

D. 
No firearms or air guns shall be discharged on the premises.
E. 
No vehicle with sleeping accommodations or capable of being used for sleeping purposes shall be allowed on the premises during the period of 10:00 p.m., prevailing time, until sunrise.
F. 
No off-highway motorized vehicles will be allowed on the premises, including but not limited to snowmobiles, dune buggies and trail bikes.
G. 
Trash may not be discarded on the property except by the use of trash containers provided therefor.
2. 
The sale of alcoholic beverages for the public fund-raising purposes and the consumption of alcoholic beverages shall be permitted in the public parks of the Township solely for special events after written application to the Township and a permit issued by the Township under the following conditions:

A. 
Any party desiring to sell alcoholic beverages for public fund-raising purposes in the parks of the Township shall file written application to the Township and pay whatever application fee is in place at that time.
B. 
Any written application to the Township for permit to sell alcoholic beverages at a special event in the public parks of the Township shall be accompanied by the appropriate license or permit issued by the Pennsylvania Liquor Control Board.
C. 
If the applicant does not have the appropriate license or permit from the Pennsylvania Liquor Control Board at the time of application, the Township may grant a permit based upon a representation from the applicant that the applicant has filed the appropriate application with the Pennsylvania Liquor Control Board, and any permit issued shall be contingent upon receipt of the appropriate license and/or permit from the Pennsylvania Liquor Control Board, and such permit or license shall be supplied to the Township before the date of the special event.
D. 
Applicant shall agree to be responsible for the cleanup of any debris, rubbish, papers, bottles, and any other refuse located upon the park grounds at the time of and immediately after the special event. Applicant shall agree to sign a bond in favor of the Township in an amount to be set by the Township at the time of the issuance of the permit for the purposes of bonding the Township regarding any cleanup costs made necessary by the special event.
E. 
The applicant shall have insurance issued by an insurance company for purposes of insuring against any liability which may arise because of the special event and the Township shall be listed upon the policy as an additional insured.
F. 
The applicant shall be responsible for the behavior and conduct of the people attending the special event, and, if the applicant fails to maintain public order at the special event, the Township reserves the right to order the cessation of the special event due to the lack of the appropriate public decorum.
G. 
Attendees at the special event shall observe appropriate public decorum as well as abide by any and all other rules promulgated by the Township regarding conduct in the public parks of the Township.

There shall be no swimming and/or boating permitted, except for boats with electric trolling motors, in any park owned by Jackson Township. Boats permitted to use park waters must carry Coast Guard approved personal flotation devices for each person on board, in accordance with 58 Pa. Code 87.6.

Use of Township parks is hereby expressly limited to the following hours: September 1 to March 31, 7:00 a.m. to 7:00 p.m.; April 1 to August 31, 7:00 a.m. to 9:00 p.m.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.
