For the purpose of regulating the use of the streets and public ways of the city by pedestrians, persons driving vehicles, and persons riding or driving animals, there is hereby adopted the Uniform Act Regulating Traffic on Highways, the same being article 6701d, Vernon’s Annotated Civil Statutes.

Editor’s note(s)–Section 1 of an ordinance enacted Apr. 19, 1990, repealed sec. 25-2, which pertained to fines for traffic violations and derived from a motion of Aug. 23, 1971; and an ordinance of Mar. 6, 1979. Section 2 of the Apr. 19, 1990, ordinance set out penalties for violation of certain provisions of this chapter which the editor, at his discretion, has included herein as a new sec. 25-2.

Any person who operates a motor vehicle in the city in such a manner as to be negligent (as that term is defined in the penal code of the state) in colliding with another vehicle, person, or object, shall be guilty of negligent collision. Negligent collision shall constitute a misdemeanor.

It shall be unlawful for any person to permit any railroad car or engine to stand on any street crossing for a longer time than five (5) minutes at any one time, and any conductor, engineer, yardmaster or any other person, having immediate control of such car or engine, violating the provisions of this section shall be fined as provided in section 1-5.

It shall be the duty of each railroad company operating a railway through this city to place a flagman at each of the principal crossings on its line at all times when trains may be switching, who shall warn persons passing of the approach of trains; provided, this requirement shall not apply at crossings where approved automatic warning devices are in place and operative. The crossings, at which flagmen shall be placed, shall be designated by the city manager, and any violation or failure on the part of the employees of said railroad companies to comply with this section shall subject the employee, flagman, conductor or engineer of the train so switching without flagman at the crossings designated to a penalty as provided in section 1-5.

Any engineer or fireman in charge of a railroad locomotive shall ring the bell or whistle attached to his locomotive continuously through all crossings while passing through the city.
