(a) 
No person shall drive a vehicle on a highway at a speed greater than is reasonable and prudent under the conditions then existing having regard to the actual and potential hazards when approaching and crossing an intersection or a railway grade crossing, when approaching and going around a curve, when approaching a hillcrest, when traveling upon any narrow or winding roadway, or when special hazard exists with respect to pedestrians or other traffic or by reason of weather or highway conditions; and in every event, speed shall be so controlled as may be necessary to avoid colliding with any person, vehicle or other conveyance, or on entering the highway in compliance with legal requirements and the duty of all persons to use due care.
(b) 
Where no special hazard exists, that requires lower speed for compliance with subsection (a) of this section, the speed of any vehicle not in excess of thirty (30) miles per hour or if otherwise posted, the limits so posted, shall be lawful, but any speed in excess of such limits shall be prima facie evidence that the speed is not reasonable and prudent and that it is unlawful.
(c) 
It shall not be necessary for any traffic ticket, charge or complaint to state or allege that any speed in excess of the rates prescribed are not reasonable and prudent under the circumstances, as the governing body has determined that such excessive speeds are unreasonable and imprudent.
(d) 
The following school crossing zones will be posted, and it shall be unlawful for any vehicle to travel within any designated school crossing zone in excess of the posted speed limit during active school crossing zone times on days when school is in session. The school crossing zone times shall be posted with the speed limit for those times. Active school crossing zone times shall be determined by both the start of the school day and the dismissal of the school day. Therefore, all active school crossing zones on the city streets at the locations designated herein shall be from 7:15 a.m. to 8:15 a.m. and from 2:45 p.m. to 4:00 p.m. on days that school is in session.
(1) 
Brenham Early Childhood Learning Center — Twenty (20) miles per hour during the aforementioned times:
a. 
On S. Chappell Hill Street from E. Alamo Street to Seelhorst Street;
b. 
On E. Alamo Street from S. Chappell Hill Street to Barbee Street;
c. 
On Kerr Street from E. Alamo Street to Seelhorst Street;
d. 
On Mangrum Street from S. Chappell Hill Street to the east terminus of Mangrum Street; and
e. 
On Seelhorst Street from Kerr Street to S. Chappell Hill Street.
(2) 
Brenham Middle School and Brenham Junior High School (connected campuses)– Twenty (20) miles per hour during the aforementioned times:
a. 
On E. Tom Green Street from S. Blue Bell Road to Ledbetter Lane;
b. 
On Woodson Lane from E. Tom Green Street to Carlee Drive;
c. 
On Carlee Drive from Allyne Street to the east terminus of Carlee Drive; and
d. 
On Niebuhr Street from Eledra Street to S. Blue Bell Road.
(3) 
Brenham High School–Twenty (20) miles per hour during the aforementioned times:
a. 
On AH Ehrig Drive from N. Park Street to the east terminus of AH Ehrig Drive.
(4) 
Community Education (AEP)–Twenty (20) miles per hour during the aforementioned times:
a. 
On E. Sixth Street from S. Market Street to Marie Street.
(5) 
Krause Elementary–Fifteen (15) miles per hour during the aforementioned times:
a. 
On E. Stone Street from S. Blue Bell Road to the northeast terminus of E. Stone Street.
(6) 
Alton Elementary–Twenty (20) miles per hour during the aforementioned times:
a. 
On W. Tom Green Street from S. Austin Street to S. Market Street.
The city council of the City of Brenham declares and affixes the above maximum speed limits for the designated school crossing zones on the city streets as described herein. The department of public works is hereby authorized to erect the appropriate signage and make any necessary markings to provide notice to the public of the school crossing zones.

No person shall operate or cause to be operated any railroad train, railroad engine, railroad motor car, railroad car or similar means of transportation, upon railway tracks, within the city, at a greater rate of speed than twenty-five (25) miles per hour.
