The municipal government of the City of Mexia shall consist of the city council, which shall be composed of six (6) council members and a mayor, and shall be known as the “governing authority.” The mayor shall be elected at large. The council members shall be elected from single member districts, which may be adjusted, from time to time, by the city council as conditions change which would merit such changes according to the most current United States Census, so as to achieve the ideal of one person, one vote, and achieve compliance with the Equal Protection Clause of the Fourteenth Amendment of the Constitution of the United States of America. The mayor shall hold his office for a period of two (2) years, provided, however, that the present incumbent of the office of mayor of the City of Mexia shall serve until the expiration of his term of office or until the election and qualification of his successor.

The city council of said city shall be composed of the present seven (7) members of said city council, who shall serve until their successors are elected and qualified. The city council shall be elected, each from separate and distinct districts with the mayor elected from the city at large. Each council member shall be elected to and occupy a place on the city council, from his or her district, such places being numbered 1, 2, 3, 4, 5 and 6, to correspond with its district respectively. All council members and the mayor shall be elected at the City of Mexia’s regular election on the first Saturday in May, 1993. The mayor and three (3) members shall hold office for a period of two (2) years or until the election and qualification of their successors. The remaining members shall hold office for a period of one year or until the election and qualification of their successors. At the first council meeting after election, the six (6) council members shall draw lots to determine which three (3) shall serve initial two-year terms and which three (3) shall serve initial one-year terms. All terms of office thereafter shall be two-year terms.

Vacancies in the city council shall be filled by appointment of the city council upon a majority vote.
Each council member shall be a resident citizen of the City of Mexia and of his district, have the qualifications of the electors therein, and shall have been a resident citizen of the City of Mexia for a period of not less than one year immediately next preceding such election.
The council members and other officers and employees shall not be indebted to the city, shall not hold any other public office of emolument, except the city council may, in their discretion, select one of their number, as judge or recorder of the corporation court, in which event, said council members shall receive the salary as fixed by said council for the office of said judge or recorder of the corporation court, and neither the council members nor other, officers or employees shall be interested in the profits or emoluments.
Council members, upon receiving credible information that a council member, officer, or employee of the city is delinquent in any indebtedness to the city, shall, as soon as possible, move to formally notify the delinquent member, officer or employee or the delinquency which shall be accomplished by majority vote of the council. The delinquent member, officer or employee shall be deemed removed or employment terminated at the end of the 60th day from the above mentioned vote unless within 60 days from said vote the member, officer, or employee in question proves to the city council that there is no delinquency or any indebtedness to the city or that suitable arrangements have been made for its payment, both of which require approval by majority vote of the city council. Upon such approval the member, officer or employee shall not be removed or terminated.

There shall be and is hereby created the following offices: city manager, chief of police, tax assessor or collector, and city secretary. The city council shall have power to create such other offices and prescribe the duties thereof and make appointments thereto as may be deemed necessary and right and proper, from time to time.
