For the purpose of this division, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
Municipal building.
105 East Main, including all of the enclosed area utilized by city employees and the general public. This enclosed area includes but is not limited to utility billing, tax collections, council chambers, municipal judge’s office, commerce and tourism office, EMS training room and library and the city warehouse.
Smoke, smokes, or smoking.
(1) 
Carrying a lighted pipe, cigar or cigarette of any kind, or any other lighted smoking equipment or device; or
(2) 
The combustion of any cigar, cigarette, tobacco, or similar article or any other combustible substance in any manner.

Any person convicted of violating this division shall be guilty of a class C misdemeanor, punishable by a fine as provided in section 1.01.009 of this code, as set by municipal judge or jury.

A person commits an offense if, within a municipal building, the person smokes and fails or refuses to extinguish smoking materials or refuses to move outside the enclosed building upon request by any person to do so.

The city shall place signs at all entrance areas of the municipal building notifying the public that, on these premises, smoking is prohibited.
