(a) 
Definition.
For this section, a compression brake commonly referred to as a “jacobs” brake or “jake” brake, engine brake or dynamic braking device means a device primarily on trucks for the conversion of the diesel engine from an internal combustion engine to an air compressor by changing engine exhaust valve operation for the purpose of braking without the use of, or in addition to, wheel brakes.
(b) 
Use prohibited.
(1) 
It shall be unlawful to operate, use or permit the use or operation of the engine of a motor vehicle so as to assist in braking or slowing the vehicle through the use of gears or through the devices, engines retarding device, or other similar devices on any public right-of-way, including but not limited to state-maintained roadways, within the corporate limits of the city, except in emergencies.
(2) 
Notice of this section shall be posted at the place where the boundary of the city joins or crosses any highway by an appropriate sign notifying motorists of the passage of this section.
(c) 
Penalty.
It shall be unlawful for any person to violate any provision of this section, and any person violating or failing to comply with any provision of this section shall be fined, upon conviction, not less than two hundred dollars ($200.00) nor more than five hundred dollars ($500.00), and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues.
