For the purpose of this article, the following definitions shall apply, unless the context clearly indicates or requires a different meaning:
Motorcade.
An organized procession containing 25 or more motor vehicles, except funeral processions, upon any public street, sidewalk or alley.
Parade.
Any march or procession consisting of people, animals or vehicles, or combination thereof, except funeral processions, upon any public street, sidewalk or alley, which does not comply with normal and usual traffic regulations or controls.

No person shall knowingly join or participate in any parade, motorcade or other event conducted under permit from the police chief in violation of any of the terms of the permit, nor knowingly join or participate in any permitted parade, motorcade or other event without the consent and over the objection of the permittee, nor in any manner interfere with its progress or orderly conduct.

When a permit for any event other than a parade or motorcade is granted for the use of a public street and when the street is closed temporarily, permits may be granted for the sale of goods and merchandise on the sidewalk adjacent to the street or in the street as allowed by the applicant.

It shall be unlawful for any person to conduct a parade or motorcade or other event in or upon any public street, sidewalk or alley in the city or knowingly participate in any such parade, motorcade or other event unless and until a permit to do so has been obtained from the police chief.

No permit shall be issued authorizing the conduct of a parade, motorcade or other event which the police chief finds is proposed to be held for the sole purpose of advertising any product, goods, wares, merchandise or event and is designed to be held purely for private profit.

Any person who desires to conduct a parade, motorcade or other event shall apply to the police chief for a permit at least 10 days in advance of the date of the proposed parade, motorcade or other event. The application for such permit shall be made in writing on a form approved by the police chief. In order that adequate arrangements may be made for the proper policing of the parade, motorcade or other event, the application shall contain the following information:
(1) 
The name of the applicant, the sponsoring organization, the parade, motorcade or other event chairman and the addresses and telephone numbers of each.
(2) 
The purpose of the parade, motorcade or other event, the date when it is proposed to be conducted, the location of the assembly area, the location of the disbanding area, the route to be traveled and the approximate time when the parade, motorcade or other event will assemble, start and terminate.
(3) 
Such other information as the police chief may deem reasonably necessary.

The police chief shall, within five days of the application, issue a parade, motorcade or other event permit conditioned upon the applicant’s written agreement to comply with the terms of such permit, unless he finds that:
(1) 
The time, route or size of the parade, motorcade or other event will disrupt to an unreasonable extent the movement of other traffic.
(2) 
The parade, motorcade or other event is of a size or nature that requires the diversion of so great a number of police officers of the city to properly police same and the areas contiguous thereto that allowing it would deny reasonable police protection to the city.
(3) 
Such parade, motorcade or other event will interfere with another parade, motorcade or other event for which a permit has been issued.
(4) 
The parade, motorcade or other event will require the closing of one or more vehicle traffic lanes of a road on the state highway system for 15 minutes or more.
(5) 
The information contained in the application is found to be false or nonexistent in any material detail.
(6) 
The applicant refuses to agree to abide by or comply with all conditions of the permit.

If the parade or procession will traverse any state highway or portion thereof, the applicant shall be responsible for obtaining and paying the fee for any permit from the state department of transportation prior to receiving a permit from the city.

In each permit, the police chief shall specify as conditions thereof:
(1) 
The assembly area and time therefor;
(2) 
The starting time;
(3) 
The minimum and maximum speeds;
(4) 
The route of the parade, motorcade or other event;
(5) 
What portions of streets to be traversed may be occupied by such parade, motorcade or other event;
(6) 
The maximum number of platoons or units and the maximum and minimum intervals of space to be maintained between the units of such parade, motorcade or other event;
(7) 
The maximum length of such parade, motorcade or other event in miles or fractions thereof;
(8) 
The disbanding area and disbanding time;
(9) 
The number of persons required to monitor the parade, motorcade or other event;
(10) 
The number and type of vehicles, if any;
(11) 
The material and maximum size of any sign, banner, placard or carrying device therefor;
(12) 
The materials used in construction of floats used in any parades shall be of fire-retardant materials and shall be subject to such requirements concerning fire safety as may be determined by the fire chief;
(13) 
That the permittee advise all participants in the parade, motorcade or other event, either orally or by written notice, of the terms and conditions of the permit, prior to commencement of the parade, motorcade or other event;
(14) 
That the amplification of sound permitted to be emitted from sound trucks or bullhorns be fixed and not variable;
(15) 
That the parade or motorcade continue to move at a fixed rate of speed and that any willful delay or willful stopping of the parade or motorcade except when reasonably required for the safe and orderly conduct of the parade or motorcade shall constitute a violation of the permit;
(16) 
That the permittee agrees to hold the city harmless from any damage against all claims for damages, costs and fees attributable to the parade, motorcade or other event legally assessed against the city; and
(17) 
Such other requirements as are determined by the police chief to be reasonably necessary for the protection of persons or property.

Upon a denial by the police chief of an application, the applicant may immediately file a written appeal therefrom to the city manager, who shall schedule a hearing on the matter and render a decision thereon within 48 hours of the filing of the appeal. If the denial is affirmed by the city manager, the applicant may immediately appeal by petition for writ of certiorari to the circuit court.

Promptly upon the police chief granting a permit for a parade, motorcade or other event, he shall send a copy thereof to the following:
(1) 
The city council;
(2) 
The city manager;
(3) 
The fire chief;
(4) 
The public works director;
(5) 
The parks director.

Any permit for a parade, motorcade or other event issued pursuant to this article may be summarily revoked by the city manager when the permittee violates any permit condition, or at any time when by reason of disaster, public calamity, riot or other emergency the city manager, after consultation with the police chief, determines that the safety of the public or property requires such revocation. Notice of such action revoking a permit shall be delivered in writing to the permittee by personal service or certified mail.
